U S. S District Attorney V. W. W. W Ray today filed suit in the U. U S. S district court against the Rio Grande Fuel company asking for the cancellation of patents to the land Fred A. A Sweet president of the Standard Coal company Henry E. E Lewis a stockholder of the former company and Orrin W. W Bemis are charged with conspiracy and misrepresentation tation in the steps alleged to have been pursued to initiate the title to the lands in question According to the allegations S se forth in the complaint the Rio Grand Grandt Fuel company was incorporated on December 1 1 1915 and that prior to September 18 1915 the government was owner of certain valuable tracts of coal land comprising a total of 33 acres all being in Carbon county coun coun- ty ty Said Sald lands had been classified as as s coal lands and a price had been fixed upon each subdivision and were were wee open to entry by any person qualifies EMPLOYED DUMMY It Is then stated that prior to Sep September Sep Sep- 18 1915 Frederick A A. Sweet of Salt Luke Lake had exhausted his right to become a purchaser of coal lands from the government but that he en entered entered entered en- en into an unla plan and nd scheme with the Intent of illegally obtaining obtaining ob ob- ob- ob taming title from the United States by having the lands entered and purchased purchased purchased pur pur- chased from the United States by persons persons persons per per- sons qualified that is by dummy Frederick A A. Bemis Bemi in September 1915 to file ap applications applications ap- ap for the purchase of the lands in question each of the applicants applicants applicants ap ap- ap- ap making affidavit that they were purchasing the tho land for their own use and benefit It is alleged that such affidavits affidavits affi atei- davits weer false in that the purchasers ers were making such purchases not notI I for their own benefit benent but for Sweet I in pursuance of the illegal and fraudulent fraudulent fraudulent fraud fraud- scheme already referred to PAID It i Is further set forth that was paid for one of the parcels of land and 65 for the other the tho money being furnished and secured by Sweet Thereafter on the first day of December December December De De- De- De cember 1915 it is alleged that Sweet I caused to be organized the Rio Grande Fuel company compan of which he and Henry Lewis had control and that on the second day of December 1915 1015 Lewis transferred his title to the land to the company and on the seventh day of December Bemis transferred his title to the tho company It Is alleged that such purchases by the company were not made in good faith but were made with the knowledge of the fraud fraudin in the title as set forth In the tho prayer the complaint asks ask that the patents to the land be bo set aside and the title restored to the government and that the defendant company be made o 0 appear in court and male make full answer to the charges I set forth |
