Show i fi f CONSTITUTIONAL AMENDMENT No 1 V V A JOINT RESOLUTION PROPOSING PROPOSING PROPOSING PRO PRO- POSING TO AMEND ARTICLE ARTI CLE XIII SECTION 2 OF THE CONSTITUTION 0 OF F T THE H E EV V STATE OF UTAH RELATING TO AN AD VALOREM TAX EXEMPTION PRO PROVIDING V I DING V THAT TANGIBLE PERSONAL PROPERTY WHICH IS SHIPPED SHIPPED SHIPPED SHIP SHIP- PED BEYOND THE STATE V OF UTAH WITHIN A PERIOD OF ONE YEAR MAY BE EX- EX tEMPTED El FROM AD VALOREM VALOREM VALOREM VALOR VALOR- EM TAX Be it resolved by the Legislature Legisla- Legisla V ture of the State of Utah V two thirds of all members V elected to each df Of f the two houses voting in favor thereof there there- of Section 1 It is proposed to amend Article XIII Section 2 of the Constitution of the State of Utah to read as follows Section 2 All tangible property property property prop prop- erty in the state not exempt under the laws of the United 1 States or under this constitution I tion shall be taxed in I tion to its value to be ascertained ascer- ascer as provided by law The property of the state counties V cities towns school districts municipal corporations and public public pub pub- lic lie libraries lots with the buildings buildings build build- ings thereon used exclusively V for either religious worship or charitable purposes and places of burial not held or used for private privat or corporate benefit V shall be exempt from taxation Tangible personal property present present present pre pre- sent in m Utah on January 1 m. m which is held for sale or processing processing processing pro pro- and which is shipped to final destination outside this state within 12 months may be deemed by law to have acquired no no situs sifts in Utah for purposes of ad valorem property taxation and may be exempted by law from such taxation whether manufactured processed or produced produced produced pro pro- or otherwise originating within or without the state Water rights ditches canals reservoirs power plants pumping pump pump- ing big plants transmission lines pipes and flumes owned a and n a used by individuals or corporations corporations corporations corpora corpora- for irrigating land within the state owned by such individuals individuals indi indi- or corporations or the individual m members e m b e r s thereof shall not be separately taxed so lon long as they shall be owned and used exclusively for such purposes Power plants power transmission I ines lines and other property used for generating and nod delivering electrical power a portion of which is used for furnishing famishing power for pumping water for irrigation purposes on lands in the state of Utah may be exempted from taxation to toV V the extent that such property is used ased for such purposes These exemptions shall snail accrue to the o ot the users of oZ water so pumped under such regulations as the legislature may prescribe The taxes of the indigent poor may be remitted or abated at such suell times and in such manner as may be provided by law The legislature may provide for the exemption f fro from r o m taxation o 0 of I f homes homesteads and personal persona person person- a al property not to exceed 2000 in value for homes and homesteads homesteads homesteads home home- and all household furnishings furn furn- furniture and equipment equip equipment equip equip- ment meat used exclusively by the owner thereof at his place of abode in in maintaining a home for himself and family Property not to exceed in value owned by disabled persons who served in a any y war in the military military mili mill tary service of the United States or of the state of Utah and by bythe bythe the unmarried widows and minor min mm- or orphans of such disabled persons persons persons per per- sons or of persons who while serving in the military service of the United States or the state of Utah were killed in action or died as a result of such service ce may be exempted as the legislature legislature legislature legis legis- V lature may provide The legislature shall provide by law for an an annual tax sufficient sufficient sufficient suf suf- with other sources of revenue to defray the estimated ordinary expenses of the state for each fiscal year For the purpose of paying the state debt if any there be the legislature legislature legislature legis legis- lature shall provide for levying a tax annually sufficient to pay the annual interest and to pay the principal of such debt within within within with with- in twenty years from the final passage of the law creating the debt Section 3 The secretary of state is directed to submit this proposed amendment to the electors electors elec eke tors tom of the state of Utah at the V next general election in t the h e manner provided by law Section 4 If U adopted by the electors of this state t this his amendment shall take effect upon January 1 1965 I LAMONT F.
