Show < AD VANCEIT the United States Supreme Court will do a wise and humane thing advano ing the Rudger Clawson polygamy case on the calendar and bringing it to as early a hearing and decision as possible It is highly important that the questions ques-tions raised be settled early important to the government and doubly so to a few thousand individuals If the position posi-tion assumed by these individuals be true that they have like other citizens the right to fair trials in courts bent only on dealing out evenhanded justice by methods that have been prescribed as proper and regular it is time they knew it in order that they can be relieved from the vexation and expanse of malicious mal-icious prosecutions if they are to be denied this right it is also time the decree de-cree was made that they may understand under-stand the position that they occupy as members of the community Government Govern-ment cannot afford to be vindictive and oppressive towards its citizens 1 it cannot afford to take advantage of its power to sustain its officers and representatives rep-resentatives in the violation of law in order to accomplish any result The government can better afford to have its laws broken by individuals than it can disregard its own statutes or employ em-ploy its might wrongfully It is clearenough that unless a halt be called on the part of the government much harm is going to result from the course being pursued by the court officials of-ficials in Utah Wisdom and humanity both suggestthe propriety of the officers ascertaining beyond a doubt that they are right before rushing in to work all the harm and hardship they can before being checked up but wisdom and humanity seem to cut no figure in the direction of I certain officials Results are what they I are after methods being only indifferent ly considered If all this hasty and manifestly mani-festly vindictive rush should be overturned over-turned and set aside the government would be placed in the unhappy position posi-tion of having acted unlawfully order to bring trouble and hardship upon its citizens and the latter could not help a feeling that the power which should be exercised for their protection against wrong and cruelty had been grievously abused The importance of an early opinion in the Clawson case on the material points in dispute involved should force itself upon the Supreme Court when it sees men languishing in jail without the right to bail and men and women being arrested on every hand by persons who are apparently bent on forcing many into prison with or wjtiiout proof of I guilt I |
