K letcher clerk of the united states circuit court nomination OP by conventions committees or citizens any political patty which presented candidates at the last election and also voters to the number of at least when the nomination is for an office to be chosen by the rotors of the entire or when for a district greater than a county ur by a county and 60 when for an office to be voted for in a district less than a county may nominate candidates for public office A committee appointed to any convention may also make nominations when authorized to do eo by a resolution duly passed by the convention at which it is appointed all nominations made by conventions or committees shall be certified by a written statement containing 1 names of office for which each person is nominated na ted name post office address residence and place of business 3 the party name in not more than five words which written statement must be signed by the president and secretary of the convention or the committee and also stating the residence and post office ot the parties signing the who must make oath that they were officers of such convention or committee and that the statements contained in the certificate of nomination are true to the best of their knowledge and belief lit the nomination ie made by a com the certificate must contain a copy of the resolution which authorized it to make such nomination if nomination is made other than by convention or committee it must designate alie name which the signers select in not more than five words and may appoint one or more persons to represent the signers in filling vacancies etc each voter signing a certificate must add his residence and duly acknowledge the bame certifying that he is a voter within the district or county etc and that be has truly stated bis residence no certificate cf nomination shall contain the name of more candidates than there are offices to fill if so only those which come first in order and are equally numbered with the number of offices be taken as nominated no person shall sign more than one certificate of nomination for any office FILING certificates OP nomination all certificates made by conventions and committees etc must be filed with the secretary of state fit for state or district offices not more than 60 nor less than 30 days and with county clerks if for county offices not more than GO less than 15 days before election those made by conventions must be filed with the proper officer within ten 10 days after the nominations of nomination made otherwise than by convention or committee shall be filed with the secretary of state not more than forty 40 nor less than thirty 30 days or with county clerk not more than thirty 30 nor less than fifteen 15 days before election immediately after the expiration of the time within which certificates of nomination may defiled be filed and corrections made wih he secretary of state be shall certify to the county clerks the name and description of each candidate together with the details mentioned in certificate of nomination LISTS OF candidates for at least six successive days before an election the county clerk shall publish in not more than two newspapers of the political party representing the highest and next highest vote at the last election a list of all candidates certified to him with names residence and street number place of business and political party of each in the form in which they will appear on the official ballot if no daily papers are published in the county one publication in each of two weekly newspapers and if no papers are published tho clerk must post double the number of printed lists inconspicuous places etc and six 6 days before election buet send to the election officers of each precinct from live to ten copies of the printed lists of each candidate to be voted for and these shall be posted conspicuously at least three days before election one n tice at least to be at the place where buch election is to be held objections TO nominations objections it any to nominations must be made in writing to the secretary of slate or county clerk within three 3 days after the certificates of nomination are filed and notice must bo mailed to all alie candidates affected the officers above named shall pass upon the validity of such objections within forty eight hour and euch objections may le remedied within three 3 days thereafter acceptance OF nominations every person nominated or two or more together must accept within five days after the filing of the certificate of nomination in a written declaration signed and acknowledged before an bolcer and a failure to do ceball be treated na a declination and the vacancy shall be filled as may be provided however if nominated by either ot the two leading political parties of the preceding election they are deemed to have accepted unless they file a written statement to the contrary VACANCY HOW FILLED in case of vacancy by death tion declination or failure cure or correct an insufficient or inoperative certificate of nomination the chairman and secretary of the organization shall file a certificate betting out cause of vacancy name of original nominee office name of new candidate and the fact that the committee was authorized to fill such vacancy this must be filed at least eight days before election with the proper officer who must certify it as in the original instance all resignations of candidates must be to the committee representing their party registration agents shall be appointed by the commissioner one for each precinct from the political party which cast the highest vote for governor at the preceding election within the territorial rit orial limits 0 such precinct in case of a vacancy the chairman of the board of commissioners shall immediately appoint an agent who must qualify within two days after notice but in case he fails to quality voters may register in any other precinct in their county upon making sufficient proof of the facts and receive a certificate of registration which will entitle them to vote in the precinct in which they reside A house to house canvass must be made the registration agents between be and of september the days to be designated by the county commissioners between the hours of 8 a m and 8 p m all agents must keep open offices in their respective precincts on tuesday and saturday of the week beginning with the second monday in october of each year tuesday october 13 and saturday october 17 1896 from 8 a m to 9 p and shall register all whose names were not registered during the house to house canvass the agents will be supplied with official registers and copy of the law per canine to their duties all registry agents must post notices in at least five 5 conspicuous places in their precincts twenty days before the expiration of the time for taft ahouee to bouse canvass specifying the time place etc for the registration OATH OF each person applying to be registered must subscribe to the following oath f 1 I do solemnly swear or affirm thata am a citizen of the united states and shall have been euch for ninety days prior to the election on the 3rd day of november that I 1 shall have attained the age of twenty one and upwards and shall have been a resident of the state of utah for one year and of the county of tour months and the precinct of no in the county of for sixty days at be time of the election on the 3rd day of november and that I 1 am not registered elsewhere in the state of utah for this electoral year so help me god or under the pains and penalties of perjury it the registry agent does not know that the applicant is entitled to register or if the applicant is challenged by a qualified elector of the county the agents may require answers to be made under oath as to citizenship age residence and registration elsewhere in the state etc if the applicant is a naturalized citizen a certified copy of bis papers must be produced and duly stamped by the agent if such have been lost or destroyed st then upon answering satisfactorily the questions prescribed by law and on affirmation of one or more witnesses as to the credibility of the applicant cant he may be registered POSTING LISTS within five days after the house to house canvass has been completed registry agents arrange a list of all names on their registers alphabetically and post the fame in some conspicuous place in their respective precincts and when the registration ia finally closed they must tilso within five days post one or more copies in public places in the precinct and within two days send a copy under their certificate to the county clerk to be by him posted in his office until election day and thereafter filed VOTING objections and corrections to the liba of voters must bo received by the registry agent up and until 6 p m on the day previous to the election friday october these must be made by qualified electors in writing and duly verified and noted on the registry lists by the agents in case of change of precinct by any voter to day 0 election be may apply to the agent and have his name stricken off and receive a transfer which will entitle him to bo registered in any ether precinct in the slate it it to the agent receiving the same that the applicant will have resided the time required by law in such county and precinct to which he may have removed ELECTION A general election will be held on tuesday november pursuant to the call of the governor and the provisions of law to elect the following officers three electors ot president and vice president ol 01 the united states A representative in the fifty fifth congress of the united states one detate senator in each of the following senatorial districts the first second third fifth eighth ninth tenth eleventh and twelfth two detato senators eena tors from each of the following senatorial districts the fourth and seventh five state senators from the sixth senatorial district one representative in the state legislature from each of the following representative districts the first third fifth sixth seventh ninth tenth twelfth thirteenth fifteenth sixteenth seventeenth eighteenth nineteenth twentieth twenty first twenty second twenty third twenty fourth twenty fifth twenty sixth and twenty seventh two representatives in the state legislature from the fourteenth tive district three representatives in the state legislature representative district four representatives in the state legislature from each of the following depre districts the fourth and eleventh ten representatives in the elate legislature from the eighth representative district two judeen in the third judicial district for terms one judge in abd tbd fourth judicial district for unc term in each county in the state three county commissioners a county clerk a sheriff a recorder a county attorney an assessor a treasurer and a surveyor in each county bavine a property valuation exceeding twenty millions of dollars a county auditor in each precinct in the state a justice of the peace and a constable county commissioners upon receiving copies of the proclamation may cause the same to be published in some newspaper in the county and posted at each place of election ten 10 days before the election ELECTION SUPPLIES county commissioners must furnish necessary poll books printed ballots and cards of instructions together with the booths for voting purposes at public expense at least ten days before election the county clerks must forward two poll books to the judges of the several precincts JUDGES OF ELECTION the county commissioners must appoint three judges for each election precinct two of whom must be of opposite political parties from lists submitted by the various political organizations no required by statute it any judge fails to act the electors assembled on the morning ol 01 election to the number of at least six may choose one from the political party in which such vacancy occurs 0 VOTING PLACES voting places for each precinct must be designated by the county cammi a sio ners and a sufficient number of voting booths one for every fifty voters at last election necessary paper ink pens and one balloting box for each polling place be supplied A guard rail must be placed so as to keep all persons except those allowed inside at least six feet from alie ballot box and booths only election officers one watcher from each party and four persons in excess of the booths shall be allowed inside of the rail at one liine county clerks must provide printed ballots for every election ifor the election in 1896 there must be two hundred ballots for every fifty voters cast at the preceding election which must be sent in packages to each precinct by noon on monday preceding the election if not so delivered it shall be tha duty of such officer to provide substitute ballots and if from any cause either shall be exhausted or misplaced unofficial ballots printed or written as near as may bo like tho official ballots can be used the official ballots shall have printed thereon the name of every candidate chuse name has been pro pertly certified to or filed with toe county clerk sample ballots end cards for public inspection spec tion mastbe prepared and in the hands of tho clerks seven days before election and delivered to election judges with twelve cards of instructions to be posted in the voting booths on election day the official ballot may be in the following form
