The plaintiffs In ihe ease are R. S. Joyce. Thomas Maloney and the Eerie Lumber coinpauy. They allege in their complaint that they are stockholders in the company aud that the sale was to be made without their consent and against their protest. They further allege that the attempted sale was to be made for the purpose of freezing out the plaintiffs, aud for the purpose of forming a new corporation. Secretary Whittmore arrived in the city early yesterday morning and was with a couple of gentlemen at the Reed hotel, during most of the day. It la reiiorted that they were the probable purchasers.
