Show evans horn attorneys TRUSTEES SALE whereas hellen fletcher by her certain deed of trust dated march A I 1 D 1894 and recorded on the day of march A D 1894 in book Z at mortgages at pages and of the records in the office of the county recorder of weber county territory now state of utah did convey to diddle reeves as trustee and in case of his refusal or failure or inability to act then to james H clemes successor in trust the following described real estate situated in the county of weber territory now state of utah to wit part of lot no nine 9 in block no ten 10 plat B city survey beginning at the northwest corner ot said lot 9 and running thence baat thirty five 35 feet chenco south twenty 20 rods thence west thirty five feet thence north twenty 20 rods to place 0 beginning together with all ditch and water rights including stock in any corporation now held or that might be hereafter acquired by the said hellen fletcher her heirs or assigns including the ditch or ditches or reservoirs now used or that may be used hereafter for the irrigation of the above mentioned lands or any part thereof and all and singular the tenements hereditaments privileges and appurtenances thereunto belonging in trust nevertheless to secure the payment of a certain promissory note made and executed by hellen fletcher and mark L fletcher march 1894 for the principle sum of 2 twenty five hundred dollars and duo and payable on the ast 1st day of april 1899 together with interest thereon at the rate of 9 per cent per annum from date payable sealan seal an dually as evidenced by ten coupon interest notes due on october ast 1st and april ast 1st of each and every year after the date of said principle note and payable to the order of the mortgage trust company of pennsylvania and more particularly described in said deed of trust to which reference Is hereby made tor all purposes and whereas said deed of trust provided that in case ot default in the payment of said promissory note or any part thereof or of the said interest notes or any of them or any part thereof according to the tenor and effect thereof then said trustee or hia successor in trust were authorized and empowered to sell and dispose of said prem isea at public auction at the front door of tho county court house in weber county state of utah to the highest bidder for cash first giving four weeks notice of such sale by advertisement in any newspaper published in said county and whereas default has been made in the payment of all the interest notes mentioned in said trust deed due on and after april ast 1st 1896 and whereas the legal holder thereof the mortgage trust company of pennsylvania has declared the said principle note and all the interest notes wholly due and payable and the same are now unpaid or any pare thereof excepting paid august alth 1898 ana whereas biddle Reeves trustee aforesaid has died and the successor in trust mentioned in said trust deed to wit james H clemes refuses to act in said matter and whereas by reason of tho law and the premises and by request of the holder of said notes the undersigner undersigned under signed has become and Is successor in trust with full power and authority to act herein according te the terms of said deed of trust now therefore the undersigner undersigned under signed sheriff and ex officio successor in trust at the request of the legal holder of said note and notes and by virtue of the power and authority in him vested and in accordance with the provisions of said trust deed will on saturday the day of november A D 1898 at 10 in the forenoon of said day at the principle front door of the county court house of weber county now state of utah and in ogden city sell the above described premises at public auction to the highest and best bidder tor cash together with all right title benefit and equity of redemption of the ald hellen fletcher her heirs and assigns thereto for the purpose of paying said promissory note with interest due shercon Lher con after first paying the costs and expenses of executing this trust including reasonable compensation to said successor in trust and his attorney and all moneys advanced for in lurance taxes and other liens and assessments sess ments legally attached thereto ac to the terms of said trust deed and will make execute and acknowledge and deliver to the purchaser or chasers mr of said premises a good and sufficient deed or deeds of conveyance hereford here forc dated at ogden utah october 1898 GILBERT R BELNAP sheriff and cx successor in trust first publication oct 1898 second publication no |
