Article XIII Section 3 of the Utah Constitution states that the legislature shall provide by law a uniform rate of assessment and taxation on all tangible property in the state, according to its value in money.. The state legislature, in 1 of the Utah statutes, set an assessment rate of 20 percent for all taxable property (the assessed value of a piece of property is equal to 20 percent of its fair cash value.) The state constitution also created the State Tax Commission and empowered it with the authority and responsibility to equalize the assessment and valuation of taxable property within the several counties. of the Utah code specifically provides that the state tax commission shall administer and supervise a revaluation of all property in each county once every five years. (The Tax Commission has just completed its first cycle of revaluations with Weber County having been revalued in 1972-73The next revaluation of Weber County will probably take place in .) 1982. Under present legislative guidelines, all counties are to be revalued so that the market value, fair cash value, used throughout the state as the basis for assessment is a 1978 market value. The intention is to establish equality by having all property in the state assessed on the same base year data. There is even some questions as to 1 whether your property taxes should increase at all. of the Utah State Statutes provides that in the year of revaluation most of the taxing bodies can not increase their property tax revenues by more than 6 percent. In fact, the 1978 revaluation of Salt Lake County saw 90 percent of the increase in property tax revenues go to the school districts with the other ten percent being divided among the other taxing bodies such as Salt Lake County, the cities, the water and sewer boards and the special service districts. The four school districts reduced their levies about 32 percent while the other taxing bodies reduced their levies about 45 to 50 percent. Since 50 percent of the property tax revenues go to schools, the revaluation of Weber County could mean a significant increase in property taxes. The question to be asked is, does it have to? If market values and consequently assessed values double because of the revaluation, why cant all taxing bodies, including the schools, reduce their mill levies so that there is only a nominal, 6 percent, increase in property taxes? That question should be addressed to your school boards, your legislators and your local elected officials. The point to be made is that a 1982 revaluation of Weber County will not automatically double your taxes. A doubling of values could be offset by a reduction in mill levies. The purpose of the revaluation law is not to generate additional revenues; rather it is to equalize property values to ensure that all property owners are paying their fair share, no more and no less.
