Three Votes The Count Up to Date Gives Thompson aGain of Four Votes Short Order Court Notes and Probate Orders The suit of J M Stoutt vs Nat M Brigham was on trial yesterday before Judge Kilos a jury being waived Attorneys At-torneys Cherry and Sheppard appearing appear-ing for the plaintiff and Attorneys Judd and Lee of Booth Lee Gray for the defense The plaintiff sued to recover 177863 the value of certain furniture and personal per-sonal property alleged to have been wrongfully and illegally levied upon by Marshal Brigham the defendant The plaintiff alleged that on August 291893 Joseph A Morlan was indebted to the Utah National bank In the sum of 19000 on D promissory note executed execu-ted in favor of the cashier of the bank Joseph 11 Stoutt and that as part of the security for the payment of the same Morlan executed and delivered to the plaintiff a chattel mortgage on the furniture named and that on October 25 1893 the defendant seized and sold the goods Defendant alleged the goods in question were not worth to exceed 563455 and that the chattel mortgage was made for the purpose of hindering and defrauding the creditors cred-itors of Morlan The case was proceeding when court adjourned until this morning Verdict For Jack Bolton The case of Jack Bolton vs J 1 Thomas et a1 was tried before Judge Street and a jury with Attorney J 1 Bowman appearing for the plaintiff and J M Thomas and W A Beyers for the defendant The case came up on appeal from United States Commissioner Green mans court where judgment was TPI dered for the plaintiff for 57 and 1195 costs for money received from A G Worrell for the use and benefit of the plaintiff The defendants denied that they owed the plaintiff any sum greater than 835 5780 The jury found for the plaintiff fo A Question or Rent G S Holmes against Cheshire Bailey et al was tried before Judge Street yesterday The plaintiff sought to recover 1830 for the rental of certain cer-tain premises on Commercial street It being alleged that the defendants on April 1 1893 took a lease on the place for two years at a rent of 1200 per annum and vacated the same after paying 570 only The defendants contended that the rent was reduced to 6250 a month on August 1 1893 and that they owed the plaintiff only 50 They denied they ttook the lease as partners and also denied that they had been evicted evict-ed Judge Powers and George West ervelt were the attorneys for the plaintiff and Attorney S H Lewis represented re-presented the defendants The case was tried without a jury and his honor took It under advisement Young Gains Three Votes The counting of ballots in the Thompson vs Young quo warranto case resulted yesterday in a gain of two votes by Young and a gain of one vote by Thompson in the municipal box at poll 1 Second precinct Salt Lake city a gain of three by Young at pol 2 municipal box Second pre cinct Salt Lake city a gain of two by Young o recount of state box at poll 2 Second precinct Salt Lake city a gain of two for Thompson on recount re-count of state box poll 3 Second precinct pre-cinct Salt Lake city a gain of two for Thompson and a gain of one for Young in poll 5 municipal box Second precinct Salt Lake city making a net gain for Young on ithe days count of three votes Since the count ha begun Thompson Thomp-son has gained fourteen votes and Young ten making a net gain for Thompson up to date of four votes There are about ten or twelve ballots bal-lots which the referee has not passed on about half of which were offered b Youngs counsel and the others by Thompsons friends These ballots are mutilated partly scratched and so forth so that it is hard to decide whether they should be counted or thrown out altogether Suit For Divorce Sarah E Olger is suing for a divorce from George W Olger alleging that the marriage took place on May 6 1877 alt Manchester Wis and that for more han a year lat past the defendant defend-ant ha failed to provide her with the common
