Show ISAAC GROO'S FINE AND COSTS. He is Liberated From the Pen, Bttt Detained in Custody by the marshal. When the several parties whose terms ; of imprisonment for unlawful cohabitation cohabita-tion expired to-day, came up from the penitentiary this morning, there was a question raised as to whether Isaac Groo could consistently make the necessary-affidavit necessary-affidavit setting forth that he did not possess more than $20 worth of property exempt from execution. exe-cution. It had come to the ears of the Court that Mr. Groo owns $500 or $600 worth of real estate in Wyoming, and upon this grounds the matter was taken before Commissioner McKay. Mr. j Movie, in representing Groo's case stated that the defendant had served the additional thirty day time in order to satisfy the Court, and he had done this without any knowledge that he would still be held j answerable for the fine and costs. The ; matter was argued briefly and submitted j to the Commissioner, who had not de- livered his judgment or opinion up to a late hour this afternoon, and Mr. Groo was still in the hands of the Marshal. A gentleman who is related to the Groo family told a Democrat reporter this afternoon that he thought Mr. Groo's property in Wyoming had been sold several years ago and that he (Groo) did not own a dollar of any kind of property. He was not sure however. It appears Mr. Groo deeded his city real estate to his wives some years ago and that his reputed possessions in Wyoming, were therefore the only hope the court had for holding him. There can be no question of the ability of the court to attach property outside of this Territory, and if it can be shown that the real estate in question is really Groo's he will be sent back at once to'the Pen until some result can be reached. It was the very general impression around the Marshal's office that he would be taken out to his dreary confinement this evening, even-ing, at all events, but it is possible that Commissioner McKay may decide otherwise other-wise this afternoon. |
