Up-I case was continued The White polygamy court tinned in Commissioner McKays this morning When the defendant Charles L White put in an appearance at 1 oclock he looked seriously thoughtful thought-ful from a night in the Pen Mr Kirk Patrick arrived for the defense and Assistant As-sistant Prosecuting Attorney Varian proceeded pro-ceeded with the examination of witnesses wit-nesses subpojnaed in the case MRS WILLIAM WAYNE A sister of Lizzie Starkey the alleged wife was sworn and put on the stand Q Where do you live AIn the Nineteenth ward Salt Lake City Q Where from the defendants house AI live at number 35 Caine street about three blocks from Whites house QDo you know his wife and family AYes I have known them about two years I QHave you been on visiting term with them I AI used to call but ceased visiting them about six months ago QIs Elizabeth A Starkey a relative of yours LYes sir she is my sister i QHow long have you lived in Utah AVe came from England about three years ago and my parents brothers and sisters live in Hooperville about five miles this side of Ogden Q Where has Elizabeth your sister lived since coming to Utah I AOne year ago last March she made I her home with me for three months in the Nineteenth Ward QYhere else did she live AShe went as nurse to Mrs John sons and stayed about five weeks QThen where did she go AShe went to Mr Whites and stayed about six months This was when Mrs White was sick about one year and a half ago QWhat can you say of Whites house AWell the house had bedrooms and a sort of shop attached QWlmere After several more questions covering the ground gone over during which very little evidence of material benefit was obtained the prosecution called Mrs Connelly MRS CONNELLYS TESTIMONY She testified to living in the Nineteenth ward and to knowing White and family including Lizzie who slept in her house in the part rented by White She became acquainted with the defendant and wife over three years ago Was at their house before White went to Arizona on his mission mis-sion Saw Lizzie the alleged second wife at that time in the family She got Lizzie a place to work She had charge of a pair of twin babies which she used to wheel about in a carriage My daughter daugh-ter was then at home and did the work while I followed midwifery She is married mar-ried now and living in Spring Hill Montana Mon-tana Her name is Mollie Gleed Q Did you ever hear defendant speak of Lizzie as his wife or did you eyer see anything representing married life in their actions while at your house AVhite said that Lizzie was nothing to him but a friend hired to do work I offered her a room up stairs for I know there is so much talk and trouble nowadays nowa-days Mrs White said she could make Lizzie a bedroom down stairs JOHN CARKUTIIERS Said he lived in the Eighteenth ward and was a laborer here in the city Has lived in Salt Lake thirteen years known White for ten years and is an uncle to Whites wife Didnt know whether White and his supposedtobe wife are married or not because de didnt see the affair take place Had seen children at the house calling Mr and Mrs White father and mother and bearing their names yet he did not know about these things and would not be certain As to Elizabeth Ann Starkey he knew her and had shaken hands in a friendly manner but any further knowledge was met with the he knew the White family and Lizzie They had lived in his house four months Could not state whether Elizabeth is married or not Didnt know whether she is recognized in Vhites family as his wife He had not spoken to her for six months Attended none of the ard meetings Mr Kirkpatrick moved the Court to dismiss the case Mr Varian objected md the Court said the case is in a very peculiar phase and with
