Show ATTORNEY CLUFF ON ABSENT VOTERS BALLOTS the following lotar was sent to the alia standard for publication that all concerned may have full knowledge of cl tile the matter is self explanatory it reads to the county clerk of the respective counties in the state ot of utah and to whom it may concern the lature ot of 1919 passed a law entitled voting of absent electors which provides that absent voters ballots must be printed and in lle hands or of the clerks or 0 the le ie counties ot of this state at least fifteen days before the day of election owing to the tact fact that the time tor cor filing certificates of 0 nomination of f candidates whose names are to on the ballots tor for the goneril general alc clion i was not changed there Is in apparent conflict which to save possible expense trouble rouble and dis elsion eo sion should be reconciled lied at abis lima it is my opinion that the absent voters ballot law takes precedence ot of conflicting sections ot of the statutes of utah and that in order to give coper and necessary working effect to lo this law the time for or filing of 0 certificates 0 of nomination with the county clerks alp should be construed to advance to it 11 date not less than eleven days prior to the day upon which the clerk Is required to prepare have printed and delivered absent voters ballots which Is fifteen days prior to the day of 0 elec lion thus making the date tor for filing these certificates of 0 nomination not loss than twenty six days prior to election or october 12 1922 this will ivill allow time for or county clerks to have printed and ready for or delivery valid absent voters ballots ballo tb it is my advice to all county clerks that they refuse to accept and file any certificate of 0 nomination unless itch certificate bo be presented at least twenty six days prior to election day it this ruling is followed and publicity given to th epame in order that it may be generally understood it will avoid a great amount of trouble and perhaps unnecessary expense I 1 respectfully fully advise that all political lotical pantries and others who aro are interested te in having nominations placed upon the official ballots for the election in november 1922 hold conventions prepare their certificates and arrange all matters connected with the ilia nom nomination illation of candidates for office early enough to permit tile the riling of such certificates not less than twenty six lays prior to election day since this Is a matter of general Ki Ila terest I 1 would suggest that the county clerks make it a point to have their local papers give publicity to this ruling in order to avoid friction at the last minute respectfully HARVEY CLUFF attorney general ot utah 4 |
