Said tank is to be constructed and operated with due care so as to avoid Injury and damage therefrom. SECTION 2. That Mount Pleasant shall In no way be liable or responsible for any accident acci-dent or damage that may occur-in the construction, con-struction, maintenance or operation of said tank-by reason of the default or misconduct of said Continental Oil Company, or its successors suc-cessors or assigns, ortlieiremployees, and the acceutanee of this grant shall be deemed an agreement on the part of said grantee for itself it-self and its successors and assigns to save Mount. Pleasant harmless from and against all liability, loss, cost, expense or damage of any nature arising out of sueb default or misconduct, mis-conduct, or which may accrue by reason ol any accident or injury which may occur in or by reason of the construction, niatntainance or operation of said tank as authorized by the terms of this ordinance, and to Indemnify and pay said Mount Pie isaut for any loss, cosls. expenses or damage of any kind it may sustain by reason of such default, misconduct, accl dent or injury that shall be recovered.against said city. SECTION S. The provisions of this ordinance ordin-ance shall be void unless an unconditional "ricceptance thereof In writing be placed on file in the oftice of the City Recorder of said Mount Pleasant, by said Continental Oil Company, Com-pany, within thirty days after the passage and approval of this ordinance SECTION 4. The City Council reserves the right to require the said erantee, its successors suc-cessors aud assigns, to confirm to all the ordinances or-dinances of the city, now or hereafter In force In the construction, maintenance and operation of said tanks; and the privileges granted by this ordinance are to be enjoyed subject to such reasonable rules and regulations regula-tions and ordinances now or hereafter to be adopted in the exercise of ihe police powers of said City, as the Mayor and City Couucll of said City shall see lit at any time to adopt. SECTION 5. A failure to comply with any of the provisions of this ordinance shall work a forfeiture of the rights, privileges, and franchises granted, andsald forfeiture may be declared by the City Council. SECTION 6, The right herehy granledshall not be exclusive, but the City reserves the power to grant to others similar privileges. SECTION 7. This ordinance shall take e licet upon its passage and publication according accord-ing to law.
