Final Approval - Final approval by the Planning Commission of a plan, project, rezoning activity, or other action shall be given after all the requirements set out in the Preliminary Approval have been met and after all concerns of the Planning Commission regarding such plan, project, rezoning activity, or other action have been addressed and answered. PUBLIC NOTICE THE CITY COUNCIL HAS BEEN ASKED TO MEET TO CONSIDER THE FOLLOWING AMENDMENTS TO THE LAND MANAGEMENT CODE: Chapter V, Section 2, "SUPPLEMENTARY "SUP-PLEMENTARY REGULATIONS" REGULA-TIONS" WOULD READ AS FOLLOWS: Substandard Lots The requirements of this Code as to minimum lot area or lot width shall not prevent the use of a lot having dimensions 25'x75' or greater for a single-unit dwelling, provided such lot was owned by one person, whether jointly or with others, as of the effective date of this amendment and that the owner or owners did not own adjoining land which could have been made part of the lot and thereby satisfy the minimum setbacks required by this Code. The exception provided in this paragraph shall not apply to any parcel of land or lot which is sold, transferred, devised or divided after the effective date hereof and thereby becomes a lot having less than 37'x75' as required by this Code. Chapter 1, "GENERAL PROVISIONS", PRO-VISIONS", Section 5 - Definitions, Defini-tions, Page 2 through 9, the following amendments would be included: Preliminary Approval - Preliminary Preli-minary approval by the Planning Commission of a plan, project, rezoning activity, or other action shall only authorize further study, planning or other non-construction work on the plan, project, rezoning activity or other action. Such approval shall not be considered binding or as a final approval and any person, firm or corporation that expends time or funds in reliance thereon shall do so at their own risk. The City shall have no liability or responsibility for any cost incurred thereby nor shall its agencies be stopped by |
