matters receive early at lention from the present assembly the report of the judiciary committee on the bill tor for a fourth judicial district as referred to the committee on memorials to congress was acted on a once and to today day the committee presented the following memorial to congress on the all important subject which was adopted and bent sent to the council for their action 4 SALT LAKE CITY jan 21 1890 to the honorable the senate and house of representatives 3 of the united states in in congress Con gresa your the governor and legislative assembly of utah respectfully fully represent that by an act of congress Cong Con gregs reia entitled an act providing for an additional asso associate clat 3 justice of the eup erne eme court of the territory of utah and for other purposes approved june provision was as made for the appointment ot of an additional associate justice of the supreme court of the tile territory Tein tory of utah and said appointment has been made as in in nd sud act provided brov aided that said act acton of congress while creating treating hie ilia office of additional associate justice as aforesaid d hl 0 not provide for the creation and or caniz altion of a fourth judicial cial dietrict in said territory and in in consequence thereof i there are at present four district judges in sad ea d territory operating in three judicial districts to the great inconvenience of the judges aforesaid and of the people of said territory that your memoria liss are of the opinion in view of the tile statutes of the united S sates ates atea heretofore pa bed sed and approved au banzin bon zin the tile division of eaid said territory into three judicial d ds s tricas that the governor and legislative assembly of said territory are powerless to create crt ato a fourth judicial district or p ovide forthe organization thereof the same is necessary and will be convenient for the due proper and economical econom icil administration of the law in in said territory I 1 your memoria lists therefore respectfully fully pray your honorable body for such legislation legisa tion as will enable said governor vernor and legislative assembly to create and organize a fourth judicial district in eaid said territory and alter change and modify from time to time the organization of the several judicial districts in eaid said territory in such manner as the eale sale of tobacco in any shape to minors it passed both houses but was vetoed by governor west wesl this time a similar bill is introduced in he the rouse by air mr wood it provides that no dealer shall be allowed all owed to dispose of tobacco in ani any shape to minors except on oil a certificate from a practicing physician and that tha the penalty for any orence against the statute regulation of transitory beris berli it lt provides that the county court shall designate a certain highway in each county to be known as the tile drovers Dro vcra road 11 and that it shall ahall cause to be placed in conspicuous places on these roads guide boards this road is to be used by the drovers in taking their herds to summer and arid winter range it also prescribes that the party having charge of said road shall erect and cause to be kept in repair a fence along eaid said road and that anyone who destroys damages or in any ay way interferes ter feres with said fence or negle neglects I 1 ts to keep it in to proper shape shall be gailey of a misdemeanor and be liable is ble for the damages caused thereby this bill if passed will correct the evil of having herds passing passin 9 through the business centers of cities in the territory which lias has hitherto interfered wild ith the traffic of pedestrians and teams from all appearances the parties living in san juan and emery counties who desire to get a new county established in the northern part of the former and the southern part of the tile latter are to be d anel one o ne I 1 to disappointment it now appears
