Ho never came back, but was soon after arrested by the officers offi-cers on the charge of burglary and larceny, finally being released ou that charge because of the failure of the party causing his arrest to appear against him. The man has been In jail a number of months awaiting trial. After the jury had been sworn, Roberts' Rob-erts' attorney objected to the introduction intro-duction of testimony in the case on the grounds that the information does not state facts sufficient to conslltuto a crime. ROBERTS SS NOW ON TRIAL The jurymen selected to hear the case of the state against Henry Roberts, Rob-erts, charged with forgery, are: Alfred Al-fred Folker. C. A. Hickenloop'r, Roy W. Stone, lleber C. Osboin, Don W. Atkinson. Peter M. Folkman, Daniel C Stewart and Thomas II. Kecder. The case Is being tried before Judge Howell, the Information allecing that on March 2C. 1910, Roberts signed tbc name f Arthur V. Kauatsher to a receipt re-ceipt for a lime-check on the Southern Pacific company for .72.o9. The statement of the prosecuting attorney Is that the time check was not paid to Roberts, because ol a suspicion sus-picion that he was not Kanntshcr.
