Show ATTEMPT MADE TO GET FINE FROM DEAD MAN'S ESTATE San Francisco. Jan. 6 Despite the fact that John H. Mitchell, formerly United States senator from Oregon. ; is dead, the machinery of the law 1s still attempting to enforce a portion ol the sentence passed on him following fol-lowing his conviction in connection with the Oregon land fraud cases. A petition has been filed with tho United States circuit court of appeals here by the United States attorney ;t.r the district of Oregon asking for ; a writ of error against the Judgment : of Judge Wolverton of Oregon, who ordered the cancellation of the $1,000 f.no against Mitchell when the death nf the senator was brought to his attention. at-tention. Judge Wolverton held that thv fin which was adjudged ogaln&t : Mitchell In addition to a six mouths' prison sentence, was Imposed as a punishment and, therefore, refused to rermlt Us enforcement against the estate es-tate of the senator. Mitchell's appeal was before the supreme court at the time of his death. |
