Tho petition was signed by over 500 citizens citi-zens and taxpayers of the section of country through which the contemplated contemplat-ed road will pass. The matter was carefully considered by the commissioners and it was finally final-ly referred to Commlsslouer Matson and County Attorney Jensen, with instructions in-structions to report .upon tho matter at the next meeting of the board. There is no question but that the petition pe-tition will bo granted and tho franchise fran-chise given, it being understood that Commissioner . Matson and Attorney Jensen will, during the week, perfect the legal and other details incident to theh passing of an ordinance providing for the franchise. This is tho beginning of an electric elec-tric line to be built by David Eccles and associates which will offer transportation trans-portation facilities to all that northwest north-west portion of Weber county between Ogden and Plain City. It Is a most important move. The farmers are to grade the line and Mr. Eccles and 'associates will do tho rest, making an electric line for passenger travel and affording an excellent ex-cellent outlet for the beet crop which will be pulled to market by dummy engines. The appointment of Mrs. E. Guerln by County Recorder Joseph Wallaco as deputy recorder, and that of County Coun-ty Clerk Samuel Dye or Lawrence A-Van A-Van Dyke a3 deputy clerk, were confirmed con-firmed by the board. The two deputies depu-ties assumed their duties yesterday. The petition of Judgo Voluey C Gunncll, of the Juvenile court, asking for a detention home for Juvenile offenders, was taken under advisement, advise-ment, no particular tlmo being stated as to when a report will be made regarding re-garding the matter. Following is a draft of the proposed ordinance granting the franchise ror tho electric railroad petitioned for by Messrs. Skeen, Taylor and Child: AN ORDINANCE Granting a Franchise to Lyman Skeen, Joseph A. Taylor and J. M. Child, Their Successors and Assigns, tor the Construction and Operation ot a Railroad Within Weber County, State of Utah. Lyman Skeen, Joseph A. Taylor and J. M. Child, their successors and assigns as-signs are hereby granted a rranchlse by tho Board of County Commissioners Commission-ers of Weber County, Utah, to construct con-struct and operate a continuous line of railroad with all switches, side tracks, spurs and pole lines necessary or convenient In the construction and operation thereof for the transportation transporta-tion of pasrongers, freight, exprr?6d and mall matter over and along tho public highway from the Northern limits of Ogden City, through Harrlsvllle, Harrls-vllle, Farr West and Plain City, to the Northwest and lines of Section 32, Township 7 North of Range 2 West. Salt Lake Meridian, subject to the following conditions and restrictions: 1. No railroad shall be laid or pole line constructed until the location ot said roalroad upon the public highway high-way Is first ascertained and specified by the Board of County Commissioners and, when so laid and constructed, raid railroad and pole lino shall in all respects comply with tho specifications specifica-tions prescribed by the Board of County Coun-ty Commissioners as to the location and construction thereof. 2. Said railroad shall be constructed construct-ed and operated In such a manner as to present tho least possible obstruction obstruc-tion and Inconvenience to the traveling travel-ing public ond ample provision shall be made for tho free and unobstructed unobstruct-ed flow of water for all purposes, and all boxes and culverts which may be required shall be constructed and maintained In good condition by the said grantees, their successors and assigns. as-signs. Tho track shall bo laid and maintained on the grade established by the County Commissioners and pood substantial crossings shall be made and maintained by the grantees, their successors and assigns at the Intersection of all public and private streets and highways, and at all other. points where necessary and prescribed pre-scribed by tho said Board of County Commissioners. 3. This franchise shall not be deemed exclusive and nothing herein contained fball prevent tho said Weber County from laying gas or water mains or pipes or altering or repairing In any mannor the portion of the highway used by the said grantees, gran-tees, their successors and aeulus but all such improvements shall be mado with as little Injury to the railroad or pole lines as possible and only after reasonable notice, not exceeding exceed-ing thirty days, and the said grantees, gran-tees, their succesr ors and assigns during dur-ing the prosecution of any such work shall Lav the right to lay temporary track If necoHsary. 4. Modern improvements used In the operation of railroads for the convenience, con-venience, comfort and safety of pas-rengers pas-rengers and the employes of said rail road shall bn adopted and used and after said railroad Bhall have been electrified, car6 shall bo run thereon at regular intervals, both ways, each day and the said grantees, their successors suc-cessors and assigns shall at all times both in the construction and operation opera-tion of said railroad be subject to and conform with all reasonable rules ana regulations established by the Board of County Commissioners. 5. Said grantees, their successors and assigns hall hold Webor County harmless from any damages which any person or corporation may suffer in the construction or operation of said |
