Ross' death September 18 last from injuries injur-ies sustained In a collision at C street and First avenue two days beforo between be-tween tho surrey in which Ross was riding and Dr. Harry N. Mayo's automobile, auto-mobile, is tho basis of a damage suit filed against Dr. Mayo and Mrs. Mayo in the district court Tuesday by Mary A. Ross, widow, and Vilate E., Mary. Sarah and George Ross, children, by Mrs. Rosa as their guardian ad litem. Damagos In the sum of $23,000 are demanded. de-manded. The accident in which Ross was fatally Injured, occurred about 7: 30 p. m. While Ross, with II. J. Rom-ney. Rom-ney. H. J. Romney, Jr., and J. D. Wardrobe, were crossing the intersection inter-section of C street and FlrBt avenue, the complaint recites, Dr. Mayo ana Mrs. Mayo crashed into tho surrey at a terrific rate of speed. Ross was burled to the ground and his skull fractured, from which he died two days afterward. The complaint alleges al-leges carelessness on the part of Dr. Mayo, In that he carried no light upon up-on his automobile and failed to sound a warning.
