Show OS ES II FIJHT United States Circuit Court of Appeals Reverses Decision Coeur d'Alene Case. SAN FRANCISCO, May 17. A decision de-cision giving the Federal Mining and Smelting company of the Coeur d'Alene lead and silver district in Idaho title to $500,000 worth of ore alleged to have been extracted from beneath certain cer-tain holdings of the Star Mining com- I, ipany, was reversed by the United States circuit of appeals here today. The Star company had sought in the district court to enjoin such extraction, p holding that its property was being encroached en-croached upon. The lower court de- j elded against the Star company and the case was appealed, today's decis- j ion resulting. - Jk . r Tho defendant company had held ,A J that tho oro vein in question had . f apexed in its own ground and Iron C Crown holdings. The court held today, 1 however that tho priority of the Grouse patent did not determine the question of the priority of the discovery discov-ery of the vein. The Grouse patent was held to have determined only a " surface right.
