Butler, asking that Judgment of the jury Which recently dismissed the action of Butler against the Oregon Short Line railroad be set aside Jury In Judge A. K Fruit's courtk recently j brought in n verdict which dismissed the- act lob of the plaintiff who sought to gain damages of $30,000 for thej death of Ormond Butler, who was killed by a train at the Twelfth street crossing in April, 191 P. In tlte motion, attorneys for thej Butler estate, ask for a new trial on the grounds that there was irregularity irregu-larity of court ln the recent hearing. It Is also set forth that there was j misconduct on the part of the Jury anil accident and surprise on the part -of the plaintiff which could not have 1 been guarded against, further.
