Show BROWNS ARE FOUND GUILTY After deliberating for nearly three hours, the jury In tho case wherein .Moroni Brown and Ora D. Brown, who wore accused of disturbing the peace of Mrs. John J. McGiogor, returned re-turned a verdict of "guilty as charged In the complaint," in Judge Reedor's court Wodnesdnv night shortly before 12 o'clock. The return of tho verdict was accompanied by a recommendation recommenda-tion of leniency based upon the age of Moroni Brown and tho provocation he was subjected to at tho time he committed the rash act of trying to take Mrs. McGregor to jail by mala foice Friday night at 11 o'clock. The jury was composed of J. B. Poulson, W. B. Wilson, C. L. Leavltt and E. L Irac'. The two men who were found guilty were released upon their own lecognizanco Judge Recder will impose im-pose sentence upon them in polico court Friday morning at 10 o'clock. The ca3e was called in police court Tuesday morning at 10 o'clock. A venire of eight men was drawn for a jury. Three of the veniiemen disqualified dis-qualified themselves and a jury of four wero chosen from the remaining five. The court then adjourned until 1 30 p.ym, at which time the trial was transferred to the municipal court room in the city hall, where many neighbors and curious citizens assembled as-sembled to hear the evidence In the case. Assistant City Attorney Heywood prosecuted the case In that work he was ably assisted by Abbott Ma-glnnis. Ma-glnnis. T. D. Johnson appeared as counsel for the defendants. Mrs. McGregor, on the witness stand, told the story of the arrest She declared that she went to the street to remove a shingle from Mr. Brown's dam so that the water would not flood her yard; she was seized by Moroni Brown and his son, dragged along the sidewalk by the wrists foi three-quarters of a block and then taken the remainder of the distance to tho city jail In an auto which was kindly furnished by J D. Dee She said that she was ghen no opportunity opportu-nity to get someone to stay with her five small children before going to the police station. Mrs Pearl Doty testified that she was awakened by Mrs. McGregor's screams, and that she heard Irving Emmett and James Ballantyne pleading plead-ing with Mr. Brown to exercise more humane methods In making the arrest. ar-rest. Mr Emmett testified that when ho remonstrated and tried to get Mr Brown to release the woman and let her go to the police station volnntarlly he was told that he would bo taken along If he interfered Substantially the same evidence was submitted by Mr Dee. who took Mrs McGregor and her captors to the station in his auto On the stand Moroni Brown declared de-clared that whon he found the woman destroying his dam he told her to go home; that shewas under arre3t, and that a warrant would be issued for her the next da3 He declare 1 that she refused to go home and that she slapped him and kicked him on I he shins, whereat he seized her by the wrists and, assisted by his son Ora, took her to the police station Moroni Brown testified that he became be-came a special officer 25 or 30 yca-s ago and that he was not relieved of his authority until Chief of Police Norton took up his star this week Ora Brown and his sister, Mrs O'Neill, also took the stand to testify testi-fy on behalf of Moroni and Ora Brown, and to rehearse the troubles that the Browns and McGregors are alleged to have had for the past two years over Irrigation ditches The attorney for the defendants made a valiant effort to establish justification jus-tification as an excuse for the behavior be-havior of the Browns The testimony was all taken before G o'clock, and the court adjourned until 7.30 p. m., at which time the attorneys opened up and argued until nearlj 9 o'clock The Jury was out nearly, three hours and when it returned it handed the court a verdict of guilty |
