section 1 it Is proposed to af A mend article 13 of the constitution ot of the state ot of utah so 80 that the tha samo 4 will read as follows i f 1 the power of taxation shall i 11 never be surrendered suspended or t kt contracted away all taxes shall bo be T uniform upon the same clasa ot props orty erty within the territorial limits ot of ahe authority levying tile tho tax and sl shall be levied and collected tor for pub ile purposes only 1 2 the legislature shall provide by law for an annual tax sufficient with other sources of revenue to dotray doray the estimated ordinary expenses ot of tho the state tor for each fiscal year for the ot of paying the state debt it aidy any there bo the legislature shall provide for foi levying a tax annually sufficient lelent to pay the annual imite interest reat and principal ot of such debt within f twenty years from the final passage ot of the law creating the debt 3 there shall hall be exempt f from born P taxation property ot of the united states A ot of the state counties cities towns school municipal corpora i eions and public libraries lots with the buildings hereon used exclusive f ly tor for elthor religious worship or char table pu and places ot of burial 1 lv not hele or used tor for private or cor borate aft ditches canals reservoirs pipes and humes owned own ed and used by indic duals or corporations tor for irrigating lands owned by such individuals or corporations or the individual mem bore bers thereof shall not be separately y taxed so long as they shall bo be owned and used exclusively for such pur pose provided that mortgages upon fc real and personal property shall be s exempt from taxation i and that tho the rl taxes of tile the indigent poor may be witted or abated at such time and in such manner as may be provided by law W 4 the legislature shall not imy pose taxes tor for the purpose of any county city town or other municipal corporation but may by law vest in rf t tho the corporate authorities cherof re ively tho the power to assess assels and 4 i collect taxes taos for all purposes ot of 8 such ch jt corporation 1 l 6 5 the surface ground of all mines alnea aud and mining claims both placer t and rock in place containing or boar bear 1 ing gold copper lead iron ire or other valur blo metals after pure purchase aso i ia thereof f tram born he states s shall aall bo be taxed lt it a value pot not greater t than an I 1 the price pad the united states there V tor for unless tile surface ground or some part thereof of such mine or claim Is used for other than mining purposes and has a separate and independent value for such other purposes in which caso case said surface ground or any part thereof so used tor for other than mining purposes shall lo be taxed at its value for such other purposes as provided by law and all machinery used in mining and all property and surface improvements upon or appurtenant to mines and mining claims which have a value separate and independent of such mines or mining claims shall bo be taxed as provided by law all lands containing coal granite stone marible marble onyx gas oil hydrocarbons hydro carbons carbona gyp gypsum m or other valuable mineral deposits other than those enumerated above in this section after purchase chase thereof from the united states and all property and surface improvements upon or appurtenant to such lands which have a value separate and independent of nt nil all such lands shall be taxed as provided by law it in addition to the assessment of the stir surface grounds improvements and machinery of mines and mining claims all mines and mining claims producing net proceeds shall be taxed at a value not to exceed three times suji suh net proceeds 6 an accurate statement of the receipts and expenditures of the public moneys shall be published annually in such manner as the legislature may provide 7 1 the rate of oc taxation on property for state purposes shall never exceed eight mills on each dollar of valuation to be apportioned as aa follows not to exceed tour four and one hall half million milli mills on each dollar of valuation for general state purposes not to exceed three mills oi each dollar ot of valuation for district school purposes not to exceed ono one halt half mill on each lollar dollar of valuation tor for high school p purposes ur poses that part of the state tax apportioned to high school purposes shall constitute a fund to bo be called the high school fund and shull shall bo be apportioned to the cities and school maintaining high schools in the manner tho the legislature may provide and whenever the taxable property within the state stae sha shall amount aill to four hundred million illion dollars tho the rate shall not exceed five mills on oil each cellar ilar ot of valuation unless a propos on in to increase such rate ho he rate rata proposed and uio the time during which tho the same bamo shall bo be levied be first submitted to a vote of such buch of tho the qualified electors of the state as in the year next proceeding such auch election shall haye havo paid a klyop erty tax assessed to them within the state and the majority of those voting thereon shall voto vote in favor thereof in such manner as may bo be provided by law 8 the making of profit out of public moneys using the same for any purpose pot not authorized by law by any public officer shall be deemed a felony and shall bo be punished as pro vided aided by law but part of such punishment men t ahall be disqualification to ho hold id public office 9 no appropriation shall bo be mado made or any expenditure authorized by the legislature whereby the expenditure ot of the state during any fiscal year shall hall exceed the total tax then provided for or by law and applicable for or sue such appropriation or expenditure unless tile the legislature making such appropriation ria tion shall ahall provide for levying a sufficient tax not exceeding tho the rates allowed in section r i of tills this article to pay such appropriation or expenditure within such fiscal year this provision shall not apply to appropriations riat ions or expenditures to suppress insurrections demend the state or assist in defending the united states in time of war 10 nothing jn in this constitution shall be construed to prevent tile the legislature from providing a stamp tax or a tax based on income occupation licenses or franchises see sec 2 tho the secretary of state Is hereby ordered to give this proposition to bo be published in at least one newspaper in fit every county in the where a newspaper Is printed and published tor for two months preceding the next general election see sec 3 tula this proposition shall b submitted to the electors of this state at tile next general election for their approval or disapproval all official ballots used at such election shall have printed or written thereon the words for the amendment of article 13 of the constitution relating to taxation yes no and shall olier wise be prepared and submitted to the electors lis as may bu be otherwise provided by law and said ballot shall be received counted and canvassed and returns thereon be made in the same manner and in all respects as in or may be provided by law in ill the case casa of election of state officers see sec 4 it adopted b athe electors of
