Show SUPREME COURT HEARS MOTION The state supreme court Wednesday Wednes-day permitted the filing of a motion to quash the disbarment proceedings proceed-ings now under way against Thomas H. Burton, judge of the Fifth judicial judi-cial district and then, after bearing arguments, for both sides, denied the motion. This is taken to mean that testimony in the proceedings will be taken before the referee already appointed, ap-pointed, Judge Elias Hansen, of the Fourth district. The prosecutors have appointed bj' the court, Harvey H. Cluff, attorney general and G. Hunter Hunt-er Lunt. district attorney of the Fifth district, to be assisted by W. W. Ray, former United States attorney; attor-ney; P. T. Farnsworth, and E. A. Rogers district attorney of the Third district. The motion was opposed before the court, yesterday by Mr. Ray and Mr. Farnsworth in the argument. It was supported by Thomas Marioneaux of the numerous voluntary counsel for Judge Burton. Mr. MarioneoMx argued that only legislature, through impeachment proceedings, has power to unsea, Judge Burton, and that disbarment proceedings would be futile and contrary con-trary to public policy. lie did not like the idea of permitting a defeated defeat-ed candidate to bring such prored-j prored-j ings. 1 "If Mr. Marioneaux will make that talk before the legislature," Mr. 'Ray opined.
