' No. 7 DENTAL ADVERTISING LAt PROPOSED TO BE ENACTED BT INITIATIVE Being an act to amend Sectioa 79-6-8, Revised Re-vised Statutes of Utah, 1933, as amended by Chapter 78. Laws of Utah, 1934. (Making it legal for Dentists to Advertise.) Adver-tise.) That Section 79-6-8, Revised Statute of Utah, 1933, as amended by Chapter 78 Laws of Utah, 1935, be amended to read as follows : 79-6-8. The words "unprofessional eon-duct" eon-duct" as relating to dentists are hereby defined to include.' 1. Obtaining any fee by fraud or misrepresentation. mis-representation. 2. Employing directly or indirectly any student or unlicensed dentists, or one whose license has been revoked or suspended to perform operations of any kind or to treat lesions of the human teeth; trams or jaws, or take impressions of t-he teeth or Jaws, or to correct or attempt to correct malpositions mal-positions thereof, except' as herein provided. pro-vided. 3. Employing what are known aa cappers, cap-pers, steerers or touters to obtain business. 4. Communicating, without the consent of the patient, information acquired in j treating a patient necessary to enable him j to act for such a patient. I 5. Advertising his dental business or treatment or devices by untruthful, Im- probable or impossible statements. j 6. Making any misrepresentations or i false promises directly or indirectly to Influence, In-fluence, persuade or induce dental patron-aye. patron-aye. 7. Sharing professional fee with aa unlicensed un-licensed person or paying any person for j sending or referring patients. I 8. Practicing while hi license la suspended sus-pended 9. IX Gross immorality, disheaorabJe ea improper conduct, or conviction of a felony. fel-ony. 12, Violating or aiding others in violating violat-ing any of .the provisions of the dental practice act. IS. Refusing the Department of Registration Regis-tration or the State Board of Health, their officers or employes, access to his office, instruments, laboratory, equipment, appliances ap-pliances or sui.v'ies for the purpose of inspecting in-specting the same. 14. Keeping his office, instruments, laboratory lab-oratory equipment, appliances or suppliee in an insanitary condition. 15. Nothing herein contained shall b construed so as to prevent a duly licensed dentist in the Slate of Utah from advertising advertis-ing his profession, except the quotation of definite fixed prices, by the us? of news papers, periodicals, signs, cards, radio and other lawful means of advertising, provided, provid-ed, that all of such advertising shall be in the name of the licensed dentist who may specifically refer In such advertising te his traiinng, methed andor system SECTION 2. This act shall take effect five days after the date of the official proclamation proc-lamation by the Governor. (t) Paragraph 15 added to present law. I, M. H. Welling, Secretary of Stat of the State of Utah, do hereby certify that the foregoing is a full, true and correct copy of the Initiative law filed in my office of-fice and to be voted upon at the general election to be held November 3. 1936. I further certify that it will appear on the official ballot at the general election Nov. 3, 1936, under the number and title herein designated.
