Oovernor James II Hawlry decided on Saturday not to resign re-sign his old to accept appointment as 1'nlted Ftates senator at the hands of Lleutenint Governor SweeOier, and appointed Judge K. I. I'erky of Poise to fill the unexpired term of the late SenaforTlryburn. Governor llawloy's decision came as a Burprlne in view of the fact that Friday night he announced bis intention inten-tion of taking the appointment. His explanation Is that, as the time drew near, the bringing about of his own elevation to the place became repul-ilve. repul-ilve. It Is also known that pressure was brought to bear upon him, especially espe-cially from north Idaho, to remain governor to the end of bla term. Judge Perky Is a natire of Wayne county, Ohio, and came to Idaho In 1894, and was appointed judge of the Fourth Judicial d'atrlct la 1901. He was state Democratic chairman In 1900 and took part In the senatorial contest which resulted In the defeat of former Senator Dubois.
