Show Notice of Summons. In the District Court of the Fifth Judicial District, of the State of Utah, in and for, Millard County. Delta Land & Water Company, a corporation, Plaintiff; vs. j- SUMMONS. Frank L. Gerard and J ane Doe Gerard, (otherwise unknown) , his wife, ; Defendants. J THE STATE OF UTAH TO THE SAID DEFENDANTS: You arc hereby summoned to appear within twenty days after the service of this summons upon you, if served within with-in the county in which this action is brought, otherwise, within thirty days after service, and defend the aljuve entitled en-titled action, and in case of your failure so to do, judgment., will fie rendered against you according to the demand of the complaint, which has been tiled with the clerK of said court. This action is brought to recover a judgment against the defendant, Frank L. Gerard, for the sum of Sventy-two Hundred ($7)0.0u) Dollars, principal, and the accrued interest on the same since the lu'th day of September, 1912, on four (4) certain contracts executed by and between the Delta Land & Water Wat-er Company, a corporation, and the defendant, de-fendant, Frank L. Gerard, on the 16th day of September, 1912, by the terms of which, the said company agreed to sell to the defendant, Frank L. Gerard, certain water-rights to irrigate the S -, of the SW, the SEJ of the SWJ, the NEi of the SWJ, and the NWJ u( the SWi, all in section lb, township lBsoulh, range 7west, in Millard County, Utah, and to foreclose all the right, title and interest of the defendants in and to said water contract und water-rights and said land, and for the further sum of Six Hundred ($&)0.00) Dollars, attorney fees and for costs of suit, and fur the appoint. nent of a receiver during the pendency of this action.
