Show DEATH OF JUNIUS NIELSEN Falls Victim of Pistol Shot Following a I. .Saloon Brawl. "Murder in The I First Degree." Junius Nielsen, a young man 28 H years ot agej ton ftf the late Rasmus H Nielsen of the Ffth .ward, was In- H stantly killed Tuesday night at about H 8:15 p. m. by a man named John W. .H Att, known as a horse trader. Death H camp as the result of a pistol shot In H which the bullet entered the right S - side of the body about two Inchu 'sv from the breast bone, between the H W fourth and fifth ribs. The examlna- H tlon of the body by the doctors dls- H closed the fact that the bullet went direct through the man's heart and H dropped down against the back bone, H where It was round laying loose In the M clotted blood. H All day Wednesday was occupied by H the Inauest before William Brangham, H coroner, and P. M. Poulsen, John H Johnson and Albert Berntsen, Jury m men. The witnesses examined In the H case all told practically the same story ' as to the circumstances leading up to iH- the shooting, 1 Ben McCulloch, an employe ol the H- ' murderer, was placed on,the witness H stand to tell what he knew of the H case. He told of how the crowd met Ib the Club saloon, the word which ytssed between Nielsen and Alt over H some horse deal; how these difficulties H were settled by Att "setting up the .H drinks'1 He then related a quarrel m which followed between Isaac Elwell H' Jr. and Att, In which bad names H passed between the two. The witness H testlilcd that Elwell slapped Att In H the saloon and later gave him a 1 trouncing on the street when the lat- 1 ter was going to Ms room. Witness H said ho was In the room when Att en- tered. Soon the door was thrown open H and Att turned quickly to a near-by .1 shelf, where lay a loaded revolver, and m flred out the open door, with the re- H v g'Ut that Nielsen fell to his face, say- H lug, "for God's,sake, get a doctor " M Niels Johnson and Moroni Jensen M both testified as to the shooting, tell- 1 jng practlcall)r,the same story as Mc- H CulloclJ. H Isaac Elwell Jr., .who had been sub- -HB m 'Bfl ' ' ' pocned as a witness, was fined 15 for contempt of court, as It was necessary to send an officer for him when he was wanted to testify. Elwell related the saloon brawl and how he followed Att out on the street and gave him a beating, beat-ing, after which Att threatened his life. AM, the murderer, who also rehearsed re-hearsed the case and told of how he fired at Nielsen thinking It was Elwell, would have been an object of pity had It not been that murder hovered over him He was smlrred with blood stains from the scars on his face, Inflicted In-flicted by Elwell. His rlgnt eye wa swollen ilh a black lump under It at bleat a hen's egg. His right cheek and ear were badly lacerated and his eyes were ot a glassy appearance. J. Charles Johnson, deputy sheriff, i said he had a conversation with Att following the shooting. H said Att ! remarkedf "He beat me up and two other big wallopers came down to On-Uh On-Uh me and I took a shot at them." Oscar Swenson the last witness to testify, said at the saloon At asked him (Swenson) to accompany hjm to his room and he would get a, gun gd put Elwell to the bad '' The Jury was out abou twenty minutes min-utes when thev came tn with their verdict. The funeral services will be held Sunday at 11:30 aim. In the Fifth ward meeting house over the remains of Junius Nielsen. Mr. Nielsen Is tho husband of.a young wife whom ho married mar-ried August, 1, 1008. He also has a mother and many relatives living who are deeply grieved over .this untimely c)eath. |
