Show LOGAN CITY'S OLD COUNCIL Winds up Business by Doing Lots of Things. Votes to Build $8,000 Fire Department. The retiring city council held its last meeting Friday evening and marked the event by authorizing architects to proparo plans for a new tiro hall, the same to be a d upllcate of the No. 4 house in Salt Lake city. It is estimated that the expenditure will run up to about $8,000. This building will have two large rooms on tho lower door, and one, for a time at least, will probably be used by the p.lf.v nlllrnro city officers. Considerable routine business was cleared up by the retiring council. On recommendation of the public grounds committee, a piece of land was sold to tho North Field Irrigation Co. for A report of tho electric light plant for the nine months since May 1st 'showed a net gain of $2,985,51. The Eccles Franchise. The question of granting Mr. David Eccles a street railway franchise for which ho asked some months ago, was brought up and the franchise he desired de-sired turned down. Mr. Eccles wanted the privilege of laying light rails and a former franchise granted seems to make this Imnosslble. To tlm Honorable City Council Logan Lo-gan City Utah, Gentlemen We, j our committee appointed ap-pointed to consider the application of David Eccles for a franchise to build a street railway In Logan city, beg to report that Immediately upon being be-ing appointed wo met with a representative represen-tative of Mr. Eccles and considered the draft of a franchise proposed by him, and were able to agree with him upon the greater number of propositions proposi-tions asked, but as to the request of Mr. Eccles to use a very light rail, the question arose whether, In view of the franchise already granted to Mr. Mahler, the city was not bound to rcquhe of Mr. Ecclesthat he lay a heavy rail upon stieets where two lines might converge. A legal question ques-tion as to the construction of the Mahler franchise and the duties and obligations of the city In reference thereto arose, and after discussion, Judge Hart, who was representing Mr. Ecclesat the hearing, asked tlmo to consider the matter and consult with Mr. Eccles before making a definite defi-nite answer to the question propounded. propound-ed. This was granted by the committee, commit-tee, since which time the committee has never been notified by Judge Hart or Mr. Eccles as to their position upon up-on the mattor.nor have they ever mado any request of the committee to report anv franchise whatever to the council. coun-cil. This action of Mr. Eccles and his representative has left the matter unsettled, although various important amendments to the original franchise asked have been agreed upon, up-on, but not to such an extent as would enable or authorize tho com-mlttco com-mlttco to report any franchise and recommend Its passage, as Judge Hart stated to tho committee that Mr. Eccles made a strong point on being allowed to uso light rails throughout the city and It was entirely probable that he would not accept any franchise fran-chise if he was required to use a rail heavier than twenty pounds. As tho committee has felt that it could not properly grant a franchise for such weight rails whero tho Mahler franchise fran-chise might be infringed upon, the whole matter rested upon tho acceptance accept-ance by Mr. Eccles of a modified franchise fran-chise from that requested by him. The committee therefore recommends that tho franchise as originally requested re-quested by Mr.Ecclcs, be not granted, but that If any agreement can be entered en-tered Into between Mr. Eccles and the city as to the important point suggested, that a franchise shquld be granted., as to the requestor Mr. T.Vplrx: far n rr-Mirn nnri refund to him ijcclcs ror a return anu reiunu to mm of the deposit or 875.00 required by the ordinances of Logan cltv, we say that the request of Mr. Eccles for a franchise has never been denied, but even If It had there seems to bo no legal Justification for the payment of this money back to Mr. Eccles, merely because he might not be willing to accept ac-cept a franchise that the city could legally grant. jf E W. Nothing possible for her to do during her term of olllcc was left undone, no kindness was too great for her to render. Prest. Miss Smltu will be sadly missed by many who have had much business at tho recorder's olllce, and It is certain that the newspaper people owo her most sincere and heartiest thanks, which this part of the bunch now publicly extends. |
