Wnshlngton, Jan.- 21, General Eagan was served with legal notlco of tho ordering of a courtmartlal for his trial just boforo tho close of ofllce hours. This notlco was delivered by tho messenger of tho adjutant-general In the usual courso, and had tho effect to relieve General Kagan of his duties as commissary general ot tho United States army, pending the conclusion ot tho courtmartlal. Tho ofllce was placed in charge of Lieutenant-Colonel Goorgo II. Davis, who has been on duty thcro for some tlmo as assistant to General Eagan. It was said nt tho department that tho text of charges and specifications upon which General Eagan Is to be tried will not bo mado publlo by tho department, but will be placed in the hands ot tho judgo advocate of tho courtmartlal, Colonel Davis, and the court Itself mayglvo thcmpu,bllc!ty,. Tho charges aro conduct unbecoming an officer and a gentleman, and conduct con-duct prejudicial to good order and military discipline. General Eagan has not yet outlined the courso ho will pursue, or tho nature ot his defense, It he makes any. Ho is at present engaged in trying to secure counsel. After ho has conferred with these, ho will dotermlno upon his plea. General Miles Is not openly concerning himself with the matter, If at all. |
