No. 3) A JOINT RESOLUTION PROPOSING AN AMENDMENT OF ARTICLE VII OF THE CONSTITUTION CON-STITUTION OF THE STATE OF IDAHO AND SUBMITTING TO THE ELECTORS OF THE STATE FOR THEIR APPROVAL OR REJECTION RE-JECTION THE QUESTION OF WHETHER SAID ARTICLE SHALL BE AMENDED BY ADDING ADD-ING THERETO SECTION 17 SO AS TO PROVIDE THAT THE PROCEEDS PRO-CEEDS FROjM THE IMPOSITION OF ANY TAX ON GASOLINE AND LIKE MOTOR VEHICLE FUELS SOLD OR USED TO PROPEL MOTOR VEHICLES UPON THE HTGHWAYS OF THIS STATE AND FROM ANY TAX OR FEE FOR THE REGISTRATION OF MOTOR VEHICLES, IN EXCESS OF THE jNECESSARY COSTS OF COLLLECTION AND ADMINISTRATION, ADMINIS-TRATION, AND ANY REFUND 1R CREDITS AUTHORIZED BY LAW, SHALL BE USED EXCLUSIVELY EXCLU-SIVELY FOR THE CONSTRUCTION, CONSTRUC-TION, REPAIR, MAINTENANCE VND TRAFFIC SUPERVISION OF THE PUBLIC HIGHWAYS OF THIS STATE AND PAYMENT OF THE INTEREST AND PRINCIPAL PRINCI-PAL OF OBLIGATIONS INCURRED INCUR-RED FOR SAID PURPOSES AND FIXING THE EFFECTIVE DATE OF SUCH AMENDMENT. BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF IDAHO; SECTION 1. That Article VII of the Constitution of the State of Idaho be amended by adding there to Section 17, which shall read as follows: , Section 17. On and after July 1 1941 the proceeds from the imposition im-position of any tax on gasoline and like motor vehicle fuels sold oi used to propel motor vehicles upon up-on the highways of this state and from any tax or fee for the regis-tration regis-tration of motor vehicles, in ex, cess of the necessary costs of collection col-lection and administration and any refund or credits authorized by law, shall be used exclusively for the construction, repair, maintenance mainten-ance and traffic supervision of the public highways of this state and the payment of the interest and principal of obligations incurred for said purposes; and no part of such revenues shall, by transfer of funds or otherwise, be diverted to any other purposes whatsoever." SECTION 2. The question to be submitted to the electors of this State at the next general election shall be in form as follows: "Shall Article VII of the Constitution Consti-tution of the State of Idaho be amended by adding a new setction thereto to be known as Section 17 so as to provide that on and after July 1 1941 the proceeds from the imposition of any tax on gasoline and like motor vehicle fuels sold or used to propel motor vehicles upon the highways of this state and from any tax or fee for the registration of motor vehicles, in excess of the necessary costs of collection and administration and any refund or credits authorized by law, shall be used exclusively for the construction, repair, maintenance mainten-ance and traffic supervision of the public highways of this state and the payment of the interest and principal of obligations incurred for said purposes; and no paft of such revenues shall, by transferor transfer-or funds or otherwise, be diverted to any other purposes whatsoever. whatso-ever. No. 7) A JOINT RESOLUTION PROPOSING AN AMENDMENT TO ARTICLE 4, SECTION 18 OF THE CONSTITUTION PROVIDING PROVID-ING THAT IN THE ADMINISTRATION ADMINISTRA-TION OF MONEYS IN COOPERATION COOPER-ATION WITH THE FEDERAL GOVERNMENT THE LEGISLA TURE MAY PRESCRIBE ANY METHOD OF DISBURSEMENT REQUIRED TO OBTAIN THE BENEFITS OF FEDERAL LAWS. BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF IDAHO: SECTION 1. That Article 4, Section 18 of the Constitution of the State of Idaho be amended to read as follows; "SECTION IS. BOARD OF PRIS. ON COMMISSIONERS AND OF EXAMINERS The governor, sec retary of state, and attorney general gen-eral shall constitute a board of state prison commissioners, which board shall have such supervision of all matters connected with the state prison as may be prescribed by law. They shall aiso constitute a board of examiners, with power to examine all claims against the state, except salaries or compensation compen-sation of officers fixed by law, and perform such other duties as may be prescribed by law: PROVIDED. THAT IN THE ADMINISTRATION OF MONEYS IN COOPERATION WITH THE FEDERAL GOVERN II EXT THE LEGISLATURE MAY PRESCRIBE ANY METHOD OF DISBURSEMENT REQUIRED TO OBTAIN THE BENEFITS OF FEDERAL LAWS. And no claim against the state, except salaries and compensation of officers fixed by law, shall he passed upon by the legislature without first having been considered and acted upon by said board." |
