Show Decision Adverse To Piute Interests The water case between the Piute Reservoir & Irrigation company and the Sevier River bridge reservoi: interests, in-terests, and which occupied the attention atten-tion of Judge Elias Hansen of the Fourth district court, was ended last week, as far as the preliminary bout was concerned. The gist of .Tvdge Hansen's decision was that the i lUte reservoir interests were entitled to receive re-ceive 48,000 acre-feet of water during the present year, and that the state engineer should supply the Sevier bridge reservoir rights with 89,280 acre-feet of water, before the Piute reservoir shall be entitled to any of the stored waters. According to the decision the Sevier Se-vier river bridge reservoir is entitled to 9,280 acre-feet of water and after this is supplied then the. Piute reservoir reser-voir should next be supplied with the 48,000 acre-feet. After these two emergencies are met, the court decrees that the excess be turned to the Sevier Se-vier river bridge reservoir. A provision provi-sion is made, however, that in tho event of an unexpected flow of water during the present season, and more than is necessary to supply the Sevier river reservoir, then upon application of the Piute interests, the order may be changed and tho surplus waters applied ap-plied to the Piute reservoir. If the court orders are carried out and should there be sy shortage of water from tho-wntof sheds and no rainfall, then thousands along the upper up-per Sevier river will he effected. |
