Show United States Supreme Court has ruled that "the commission under the guise of regulation may not compel the use and operation of the company property without just compensation. The court points out that the division divi-sion of the 5-cent fare by agreement between the companies did not yield sufficient revenue to cover the opera t ing expenses; that nothing in the charter of the carrier required an exchange ex-change of transfers; and that the state is without power to demand that the traffic be carried at a loss or. without substantial compensation, over actual cost. In its decision the court says "The broad power to regulate, the state does not enjoy the freedom of the owner." REGULATORS NOT OWNERS Thirteen years ago the public Service Ser-vice Commissioner of New Yok'stirlje ordered the electrical railway operating operat-ing the Fifty-ninth St. line to exchange ex-change transfers with several companies com-panies which crossed ts line.
