Show BIG WATER CASE ARGUED; COURT DECISION APRIL 3 Arguments in the hearing of the contentions over the waters of the Piute Reservoir & Irrigation company, instituted by the Lower Sevier Water Users association, which has been before be-fore Judge Elias Hansen for the past two weeks or more, were completed at Salt Lake Tuesday evening of this week. At the conclusion of the arguments ar-guments Judge Hansen promised counsel for the respective sides that he would have his decision ready by the 3rd of April. The case was ' instiiluted and? Ian. rder issued to show cause why the Piute company should not turn down the stream waters stored in its reservoir reser-voir and in the arguments counsel for the lower interests pleaded that unless the Piute waters were released releas-ed as prayed for in the petition, de-j de-j struction would follow. Judge Han-j Han-j sen at this noint stated that the same ; would result with the upper interests, ! if it were deprived of the waters. J Attorneys for the Piute interests j declared the whole case should be de-I de-I cided upon the intent of the Deseret I company at the time the original filing fil-ing was made in 1902. How much water was needed to furnish its auxiliary aux-iliary supply is the point upon which the case hinges, they maintained. The controversy between the contending con-tending companies has aroused much interest and holders of the waters will await with eagerness the decision deci-sion of Judge Hansen. |
