Show Grants Charter Despite Protest Monday of this week, H. E. Crockett, Crock-ett, secretary of the state, decided that the Auto Club of Utah formed the same individuals who are inter- ested in the Scenic Highway association asso-ciation and accordingly issued a charter char-ter to that organization. The issuing issu-ing of the charter was bitterly opposed op-posed by the State Automobile association. as-sociation. The automobile association claimed the right to use the name Auto Club of Utah, and endeavored to show that conflict and confusion would result if the new organization was permitted permit-ted to incorporate under the. designation. designa-tion. A hearing was held last week befre Mr. Crckett and Harvey H. Cluff, state attorney general, who was called in as legal advisor. At this time both sides presented their case through their attorneys. "I decided the case after listening to the pros and cons presented by counsel for both sides," Mr. Crockett said yesterday. "Impartial considera-tionwas considera-tionwas given the evidence of both parties. "There is not sufficient similarity in the names, in my opinion, to cause conflict which would justify denying a charter to the Auto Club of Utah. If the Utah State Automobile association asso-ciation sees fit, it can, of .course, take the matter into the courts." "As one director of the Utah SJLate Automobile association," said Richard Rich-ard W. Young yesterday, "I am in favor fo fighting to the last ditch the claim of the Utah Scenic Highway association organization to the name Auto Club of Utah. The Automobile Club of Utah is an organization ol long standing, under which the Uta'n State Automobile association has its franchise in the American Automobile Automo-bile association. The use of such a title as that proposed by another organization or-ganization would be- confusing and misleading, and I believe it is subject sub-ject to injunctive action from the courts." The Scenic Highway association, which is sponsoring the Auto Cluh of Utah, is reaching out to help build Southern Utah, and for this reason is meeting strong opposition by the State Automobile association of which "Kink" Bill Rishel is at the head.
