The powers of the government gov-ernment of this Stale are divided into three distinct departments: The Legislative, Executive and Judicial, and no person or collection collec-tion of persons charged with the exorcise of powers properly belonging belong-ing to one of these departments shall exercise any powers properly belonging to either of the others, except as in tins constitution expressly ex-pressly directed or permitted. The legislative power shall he vested in a Senate and House of Representatives, which shall be designated 'The Legislative Legisla-tive Assembly of the State of Utah.' Skc. 2. Senators shall be elected for the term of four years, except as otherwise provided in this Constitution. Con-stitution. Skc. 3. No person shall he ti Congress, or other person holding an oliiee (except Notary Public, or in the militia) under the United States or this State, shall be a member of either house during his continuance in office. Si:e. S. No member of either house, shall, during the term for which he shall have been elected, receive any increase of salary or mileage under any law passed during dur-ing such term. Skc. j. The Senate shall, at the beginning and close of each regular regu-lar session, and at such other times as may be necessary, elect one of its membes l'resident, pro tempore. A majority of each house shall constitute a quorum to do business, but a smaller number may adjourn from day to day, and compel the attendance of absent members in such manner and under such penalties as ca di house may prescribe. Each house shall have the power to determine the rules of its proceedings, and punish its members or other persons for con-tempi con-tempi or disorderly behavior in its presence; to protect its members against violence or oilers of bribe or private solicitation, and with t ie concurrence of two-thirds, to exei a member, and shall have all other powers necessary for the Legislative Assembly of a fne 1 State. Representative who shall not have attained the age of twenty-one years, or a Senator who shall net have attained to the age of twenty-rive twenty-rive years, and who shall not he a citizen of the United States, and who shall not (for at least twelve months next preceding his election) have resided within the county or district in which he shall be elected. Skc. -1, The Legislative Assembly Assem-bly of this State, until otherwise provided by law, shall consist of sixteen members of the Senate, and thirty-three members of the House of Representatives. It shall be the duty ot the first Legislative Assembly to divide, the State into senatorial and representative represen-tative districts. The Senators shall be divided into two classes. Those elected from odd numbered districts shall constitute one class, and those elected from even numbered num-bered districts shall constitute the other class; and when any addi-, addi-, Lion:'.'. Kach member of the first Legislative Assembly, as a compensation for his services, shall receive five dollars for each day's attendance, and ten cents for each mile necessarily traveled in going to and returning from the seat of government to residence by the usually traveled route, and shall receive no other compensation, perquisite or allowance whatsoever. No session of the Legislative Assembly, As-sembly, after the first, which may be sixty days, shall exceed fifty days. After the first session, the compensation com-pensation of the members of the Legislative Assembly shall be as provided by law; provided, That no Legislative Assembly shall fix its own compensation. Skc. G. The Legislative Assembly Assem-bly shall meet at the seat of government gov-ernment at twelve o'clock, noon, on the first Monday of January. A. D., IS'.
