AN ORDINANCE. AN ORDINANCE RATIFYING AND confirming tho transfer or tho franchise fran-chise granted to Harvoy M. Bacon, which became effective March 2, 1S93, extending tho life of said franchise and amending tho same. Bo it ordained by tho city council of Salt Lako City. Utah: Section 1. That tho franchise heretofore here-tofore granted to Harvoy M. Bacon and his successors and assigns, to lay water wa-ter pipes in certain streets of Salt Lako City, which became effective March 2, 1893, and which by assignment has become be-come tho property of tho Hot Springs Sanitarium company, is hereby declared de-clared and ordained to be vested in said Hot Springs Sanitarium company. Sec. 2. Tho life, validity and terms of said franchise are hereby extended and ordained to bo fifty (50) years from tho timo when this amendment becomes effective, and Section 4 of said franchise Is to bo construed accordingly. accord-ingly. Sec. 3. That Section 1 of said franchise fran-chise bo amended so as to read as follows: fol-lows: Section 1. That there is hereby jcrnntod to tho Salt Lako Hot Springs Sanitarium company, tho successor and assign of Harvey M. Bacon, and to Its successors and assigns, for tho purpose of erecting and maintaining a bathing resort, or sanitarium, or both, in said city, whero tho hot mineral waters of the springs in or near the north part of tho city may be used, tho right to lay and maintain water pipe or pipes, as tho city engineer may approve, to conduct such waters along tho following follow-ing mentioned avenues, streots, roads and alloys In said city, to-wlt: Tho alloys In tho Warm Springs Subdivision, Subdivi-sion, Coment avenue, Lime avenue, Agate street, Topaz street. Gem streot, County or State road to Eighth North streot; thenco along tho County or State road; Second Wost; Seventh North, and Wall to First West, or over such portions thereof, to and along First West streot, and on Third South street from First West streot into tho property formerly known as tho "Palace "Pal-ace Stables," on Third South street, and now known as tho Sanitarium Bath House. Such pipe or pipes to bo laid at such place or places and at such dopths In said streets or avenues, roads, lanos, and alloys, and to bo of such material and of such slzo as tho city engineer may Indicate, and under tho supervision of tho supervisor of streets; and tho work of laying said pipe shall bo complotcd and in use on or before tho first day of July. 1907. Sec. 4. This franchiso extending tho franchise granted to said Hai'vey M. Bacon Is granted at tho request of said Hot Springs Sanitarium company, to enable It to replace tho plpt$ now In use with other pipe; and tho samo is granted upon the' express condition that tho work of laying said pipe uimii bo completed and in uso wltr ' twelve months from the date of tho passage of this ordinanco, and that tho bond mentioned in Section 8 of said franchise fran-chise to said Bacon shall apply to tho performance of tho conditions of this ordinanco binding on said Hot Springs Sanitarium company, and that said Hot Springs Sanitarium company shall within thirty days after the passage of this ordinanco procure the assent of tho surotles on said bond that tho samo shall be applicable to the provisions of this ordinanco, and security for its faithful performance of the conditions of this ordinanco, or they shall, within tho samo length of time, give to Salt Lako City a good and sufficient bond, to be approved by tho mayor, in tho ponal sum of twenty-five .thousand ($25,000.00) dollars, that said company will perform the conditions mentioned in this ordinance. This grant and all tho terms and conditions thereof shall bo accopted In writing by tho grantee within thirty days from tho approval of this ordinance, ordi-nance, otherwise tho samo shall bo void nnd of no effect. Sec. 5. All ordinances and parts of ordinances In conflict herewith aro hereby repealed to tho extent of such conflict. Sec. 6. This ordinanco shall tako effect ef-fect upon approval.
