Show NOTICE OF SALE OF GRAZING PREFERENCES AND GRAZING PERMITS NOTICE IS HEREBY GIVEN that Bank of Iron County, the secured party, will cause to be sold by the undersigned officer of said Bank at public auction on Friday, the 12th day of October, 1984 at the hour of 12:00 O'Clock Noon on said day on the front steps of the Garfield County Courthouse in Panguitch, Utah, the following described Interest In-terest in personal property on privileges and permits and whatever preference, entitlement, privilege, license or other interest that Irvin Heppner, Glenn Heppner, Riverdale Company, Inc., Riverdale Water Company, a corporation, Boyd N. Rucker and Charlotte E. Rucker or either or any of them, as individuals or together, may have in or to: A Permit to graze 421 head of cattle (increased permit from original 369) on the Escalante Desert and Escalante River allotments allot-ments of the Escalante Resource area administered by the Bureau of Land Management standing in the names of Irvin Heppner and Glenn Heppner, Riverdale Company, Inc. or Riverdale Water Company, a corporation together with any and all increments, increase, additions, supplements, or restoration increases in-creases which BLM has or may in the future allow or grant with respect to the permit described herein which as of this date appear on BLM records to be 421 head, which grazing permits are described in that certain security agreement dated March 6, 1981 granted to Bank of Iron County by Irvin Heppner, Glenn Heppner, Riverdale Company, Inc. and Riverdale Water Company, a corporation, cor-poration, as partial security for a Promissory Note dated March 6, 1981; and this sale is for the purpose of realizing on the personal property which is security for the indebtedness in-debtedness and as evidenced by the aforesaid security agreement and a UCC-1 Financing Statement filed in the office of the Secretary of State of the State of Utah on March 30, 1981 ' as Entry No. 821741 and a subordination subor-dination agreement executed by Boyd N. Rucker and Charlotte E. Rucker of Escalante, Utah which subordination agreement is evidenced by a security agreement and financing statement filed with the Utah Secretary of State on March 30, 1981 subordinating their interest to the lien of Bank of Iron County. This sale is further made pursuant to an Order Granting Relief from Automatic Stay issued by the United States Bankruptcy Court for the Eastern District of California in Case No. 984-00041 in Re: Riverdale Water Company, Inc., Debtor. At the aforesaid time and place the grazing permits above described will be sold at public auction to the highest bidder for cash to be paid to the secured party who will conduct the sale and thereafter entrusted to a special account as ordered by the Bankruptcy Court above-identified, if any person bids and fails to pay the property will be sold to the next highest bidder and the bidder failing to pay sna11 be liable for any deficiency.
