Thepeomeof the territory of Utah send greeting to Johan Laubender, defendant. You are hereby required to appear in an action brought against you by the above named plaintiff, in tho district court of the First J udicial District of the territory of Utah and to answer the complaint filed therein, within ten days exclusive of the day of ser-vicel ser-vicel after the service on you of this summons if seryed within this county ; or If served out of this county, but in this district, with ia twenty days; otherwise within forty days or judgment by default wiU be taken against you, according to prayer of this complaint. The said action is ji oughi to obtain a judg mentof this court dissolving the bonds of matrimony now existing between plaintiff and defendant and for costs of suit. Plaintiff alleges that plaintiff and defendant intermarried at Nurnberg, Germany, on or about tbe 30th day of August, 187(5, and ever since have teen and now are husband and wife; that the laintiff is. and has been a resident resi-dent of Utah terri-ory. for more than one year preeeeding the commencement of this action. The defendant for more than five years last past has failed to provide plaintiff with the common necessaries of life. The defendant, de-fendant, disregarding his duties asa husband, has been guilty of habitual intemperance. For fuller particulars reference is hereby made to plaintiff's complaint on file herein.- And you are hereby notified that if you fail to appear and answer tbe said complaint as above required, the said plaintiff will apply to the court for the relief herein demanded and costs of suit.
