Show ASPECIALSESS10N Of the City Council Was Held Last Night ATTHEMiYOR'S BEQUEST The City'a Property on Capitol Hill Will be Donated to the Territory Provided Prove is Made the Capital City Some Other Business Was Transacted. The special session of the city council called for last evening by Mayor Hol-brook Hol-brook convened promptly at 7 o'clock. All members except Eldredge were present. After opening and reading minutes of previous session a communication from Messrs. Waren N. Dusenberry, George Havercamp and Don R, Coray, a committee com-mittee appointed by a mass meeting of citizens of Provo held on February 7th. The commurication asked that certain lands on Capitol hill, the property of the city, together with all water rights for irrigation,together with city water from the Provo city waterworks, to be used upon the premises be given to the territory gratis only upon the express condition that the bill now before the territorial legislature establishing the capital of the territory of Utah at Provo becomes a law, and for the erection erec-tion of a capitol building thereon, Messrs. Dusenberry and Coray were heard from, after which, on motion ot McEwan the council went into committee com-mittee of the whole to consider the communication, The president appointed ap-pointed McEwan chairman of the com-mitte com-mitte of the whole. The petition was read in committee of the whole and discussed after which the committee determined to report on the communication recommending favorable fav-orable action and the committee arose. The council adopted the report of the committee and passed and adopted the following resolution: Whereas, A bill has been introduced intro-duced in the council of the thirty-first legislative assembly of the territory of utan, entitled A .Bill for an Act Locating the Seat of Government at Provo citv, Utah," and Whereas, If said bill shall become law, it will be necsssary that the people peo-ple of Provo, Utah, provide the territory terri-tory of Utah proper and suitable grounds for the location of capitol buildings and other purposes, and Whereas, Provo city, Utah, is the owner of the following described premises, to-wit: Commencing at the northeast corner of lot four, section six township seven, south of range three e4st, Salt Lake mtderian; thence west 5.42 chains; thence south one degrea west 2. 45, west one digree, north 4.52 south oue degree, nine chains, east one degree, north 4.52 chains,eist 10 degrees 10 minutes, north 7.78 chains, north one degree east 2 51 chains, east one degree, north 6 76 chains, north one degree eaet 7.13 chains west 8 55 chains to place of beginning, together with a perpetual use of such quantity of water from the waterworks of Provo citv as may be neceesary to be used for any and all purposes which are proper and suitable for said premises. Therefore be it Itesolved, By the city council of Provo city, Utah, that upon the passage of the eaid bill and upon the payment of $1.00 the mayor of Provo city, Utah, is hereby authorized and directed for and in tne name of and in behalf of Provo city, Utah, to make, execute and deliver to Utah territory a warrantee war-rantee deed to said premises :-md the city recorder is hereby authorized and directed to affix the seal of saidcity thereto. I McEwan moved that a special committee com-mittee consisting of Knudsen. chairman chair-man iirigation committee, Hoover chairman coumitt e on waterworks, the third to be appointed by tha chair, be appointed to take into consideration considera-tion the advisability of making some changes at the head of the c;ty race so that the supply for the waterworks can be partially Eettled before entering the settling basins, especially during high water. Carried. The president appointed ap-pointed himself the third member of the committee. City Attorney Whitecotton asked for assistance in the prosecution of the big water suit now pending and about coming on for trial, recommending that ex-City Attorney Houtz be employed. On motion of McEwan Mr. White-cotton White-cotton was authorized and instructed to negotiate and retain Mr. D. D Houtz as his assistant in the prosecution of this case.
