Show ALIAS. SUMMONS. IN THE DISTRICT COURT OF the First judicial district, of the territory of Utah, Tjtah county. S- G. Sly plaintiff, vs. Jacob MunU. defendant. de-fendant. The people of the territory of Utah send greeting to Jacob Muntz, defendant. You are nereoy required to appear in an action ac-tion brought against you by the above named plaintiff, in the district court of the First judicial ju-dicial district of the territory of Utah, and to answer the complaint filed therein, within ten days (exclusive ot the day of servic) after the service on you of this summons if served within this county ; or if served out of this county, but in this district within twenty days; otherwise -within forty days or judgment judg-ment by default will be taken against you, according ac-cording to prayer of this complaint. The said action in brougntto obtain a judgment judg-ment of this court against the said defendant for the sum of $1,25(1 and for costs of this suit, a'leged by plaintiff to be dua ftom defendant on the gale of a certain mining claim, situated near the tov n oi Lewiston, Fremont county, Wyoming, for the sum of $2.500 of which one half thereof iplaintiff alleges to be justly due and owing to him. For fuller and further particulars reference is hereby made to the plaintiff's complaint on file herein. And you are hereby notified that if you fail to appear and answer the said complaint as above required, the said plaintiff will take judgment against you for the sum of $1,250 and costs of suit. On reading and filing the petition of James Kirkham praying for partition of the estate of Martha Kirkham, deceased. It is ordered that Monday, the 12th day of March, A. D.
