June 8. 1 988 The Utah State Bar Association Needs of the Elderly Attorney OBrien By Michael Patrick You have just discovered that cleaner you recently for S500 docs not work purchased and probably is not even brand new like you thought it was. The person who sold you the vacuum has refused to discuss the matter with you. You dont have enough money to get the help of an attorney. What do you do? You may well consider bringing a claim in the Utah Peoples the Utah Small Claims Court, the vacuum Court Small Claims Court was set up by the Utah State Legislature to deal with claims that do not exceed $1,000. Small Claims Court allows persons to bring grievances to an impartial third party in an informal and more relaxed atmosphere than exists in other courts. You are not put at any disadvantage in Small Claims Court if you do not have a lawyer. Moreover, Small Claims Court often meets in the evening, usually a more convenient time for people to go to court than during the day. If you ave a claim that you believe cannot be resolved other than by the Small Claims Court, you should contact the Small Claims Court clerk for your particular area. The clerks phone number is readily available in the telephone directory. The clerk will be able to give you an overview of the Small Claims Court system, provide you with all necessary documents for filing a claim in the court, and instruct you as to all relevant procedures for making sure that your claim is properly brought before a small claims judge. A small claims case is begun by filing papers that give a brief description of your claim. These papers are then brought to the person against whom you have made a claim by an individual known as a process server. There is nominal cost for doing these things but if you w in your case, you can recover these costs from the other person. After these initial proceedings, both of you will appear before a judge (who may be a regular judge or a lawyer who serves as a temporary judge) and tell your sides of the story. When you do this, remember that the judge usually has no idea of who is right and who is wrong. It will be up to you to convince the judge, within the constraints of honesty, that your position is correct. This means telling the judge the complete story, including those aspects of the circumstances that do not necessarily reflect favorably on you, supporting your side of the story with any relevant witnesses or papers and asking the other person any relevant questions that you think will help the judge decide the issue. After this trial, the judge will decide whether or not you should be allowed to recover on your claim. Dan Osbum, Clarence Hicks and Nyals Andreason. The Lions Club wants to thank the citizens of Salina and the area for their support in the Flea Market sale held last Saturday. In response to the growing needs of the hungry in our state, Utahns Against Hunger is urging Utahns to set aside a portion of the produce from their home gardens and fruit trees to share with their neighbors in need. For the past six years, UAH has coordinated the distribution of garden produce and government surplus commodities to the low income Utahns during the fall harvest season. Share the Harvest distribution sites are planned for Richfield, Ml Pleasant, Ogden, Provo, Price and three Salt Lake County locations. With more than 200,000 Utahns living below the federal poverty level - half of them children, the program represents an important food resource to low income fami- lies. UAH is also anxious to work with family or commercial farmers willing to allow volunteers to glean their fields or orchards for excess fruit and vegetables.
