December 3: Opening reception for Steve Songer’s one-man show at the Eccles Community Art Center in Ogden. It will feature recent works in oil, including scenes of Ogden Valley. Construction, Residential, Commercial Call 745-1238 This is a paid advertisement DEAR UTAH RESIDENTS: Please help save our public park and trail BRIEF OUTLINE AND UPDATE OF EVENTS: 1. 2. 3. 4. 5. 6. 7. 8. 9. 10. 1972, Weber County builds road to privately owned ski resort, Powder Mountain, at a cost to taxpayers of $200,000, just to pave the road. In exchange for road, county gets 160 acres of “Wilderness Park” at the headwaters of Wolf Creek with a conveniently located 2.5 mile, 30 foot wide access trail. 1996, Weber County adopts a Master Plan for Ogden Valley, addressing a need to preserve wildlife habitat areas, and to protect stream corridors–Resolution 46-96. To sell such land violated the county’s own general plan. March 11, 1997, Commissioners hold a work session and quitclaim all 160 acres, including the trail, to Commissioner Burton’s neighbor Rulon Jones for $32,000–just $200 per acre. No appraisal and no public bid or notice. Land near this trailhead currently sells for $90,000 per acre. Land sale to Rulon Jones, who now uses the once public park for his private hunting operation, was in violation of original restrictive covenant agreement in 1972 that forbids sale for commercial use! Sale violated Utah Code 17-27-305 that requires any proposed sale of public land to be reviewed by County Planning Commission. Commissioners hold land in trust for the public. They are not to sell without “adequate consideration”; “no county shall in any means give or lease to credit or in anyway use its public asset for personal gain” – Utah Code 17-4-4-95. Recent State Supreme Court ruling (Short v. Salt Lake City) ruled that elected county attorneys are to represent the people, not the Commissioners. 1200 citizens signed petitions protesting this land sale and were ignored by Commissioners and County Attorney, who should be fighting for the people, not against them. September 1999, the law firm of Robert Sykes and Associates retained to sue Weber County Commissioners and County Attorney to compel them to void the illegal quitclaim deed. Locally elected county officials have betrayed the people, as citizens must now raise additional funds–$10,000–to pay for the recent filing of this suit in the Second Judicial District Court of Weber County. Failure to file this suit would have meant that this sale would have gone uncontested, depriving, forever, the community and future generations from enjoying the benefits of the seasonal recreation this property provides.
