Huntsville Town Adopts Resolution In Support of Disincorporation The Huntsville Town Council unanimously passed Resolution 2010-1-21 in support of a community- and state-wide effort to combat a move by Powder Mountain owners and managers to force incorporation of the Powder Mountain area and a portion of unincorporated Eden located at the bottom of the resort, which includes residents who live at the base of the mountain above Wolf Creek. In a show of support of the well-organized residents who have been working towards a solution, the council drafted the resolution, which will also be used down at the Utah Legislature indicating the broad support for the a new law being proposed that would allow the residents of the would-be-town to vote immediately to disincorporate. Resolution 2010-1-21 A resolution of support for Utah House Bill 218 and Senate Bill 34 from the Huntsville Town Council, which passed unanimously at their council meeting held January 21, 2010. To: All Utah Legislators Whereas: HB 466 was a short lived piece of legislation enacted by the Utah Legislature in 2007 and rescinded in 2008; Whereas: HB 466 provided for incorporation by large property owners without a vote of the residents, permitting developers to draw any arbitrary boundary that included at least 100 residents; Whereas: HB 466 allowed these same large property owners to select the first mayor and town council with no input from the residents that were forced into the town; Whereas: The 2007 HB 466 “company town” law was replaced in 2008 with a revised law requiring the support of a majority of the citizens to incorporate any town, and the election of town officers; Whereas: The Powder Mountain developers filed a petition to incorporate three days before the 2008 legislature convened; Whereas: The majority of the approximately 130 residents within the proposed town’s boundaries VALLEY SCHOOL cont. from page 1 be put up for sale. “A developer could develop it and get six lots right in the center of town. Huntsville Town is also interested in purchasing the land if they can find the funding,” Wilson said. “The parcel is about six acres. The lots in town are quarter-acre lots.” The original school was there in 1942. Prior to the demolition of the school, the have been fighting to keep this incorporation from occurring; Whereas: In the 2009 legislative session a bill which would permit a disincorporation election in less than the standard two year waiting period, applicable only to Powder Mountain, was introduced, passed the Utah House and had a majority of senators committed to vote in favor of the bill; Whereas: The Senate adjourned an hour early on the last day, with this bill next on the agenda; Whereas: Similar bills are being introduced this year in the Senate (SB 34) and the House (HB 218); Whereas: It is important that these bills are passed to correct this great injustice to our Ogden Valley neighbors; Whereas: The proposed Powder Mountain Town is the only municipality that meets the standards for an early disincorporation election outlined in the new law; And Whereas: Developers do not have the right to take away the rights of citizens to choose those who will govern them; Now Therefore Be It Resolved: The Huntsville Town Council hereby supports SB 34 and HB 218 and urges the Utah League of Cities and Towns to support these bills and all Utah Legislators to vote for the respective bills. Weber School District is offering the gymnasium floor for sale. Removal of the wood floor will be at the expense of the successful bidder.
