By Shanna Francis Ogden Valley News | Property Wrongs: Mansell bill would destroy local control, zoning law Tribune Editorial 1, 2006 Take a Virtual Tour of the Utah State Capitol Guest Commentary Those pushing a bill that would eviscerate the ability of Utah communities to direct their own development would tell you—if they thought it was any of your business, which they don’t—that the point of Senate Bill 170 is to protect property rights. But the bill would actually do exactly the opposite. Its obvious purpose is to make the rights of mortgage-paying homeowners subservient to the rights of high-rolling developers who want the right to invade any community or neighborhood they want so they can make still more money. And don’t let the sponsor of SB170, the senior senator from real estate, tell a muh different. Al sell, a Sandy Republican who has ilies hitches as both president of the Utah Senate and president of the National Association of Realtors, has dumped on his colleagues an 80-page proposal to deny local elected officials any meaningful authority over development in their communities. Everything would be rubber-stamped by mayors or city staff. There would be no public notice, no public hearing, no opportunities for people worried about the impact of new developments on the values of their own properties or the quality of life in their own communities. No way to stop, improve or even know about plans for anything from a giant housing subdivision to a SuperStuffMart to a slaughterhouse across the road.
