Requires a prospecting permit to prospect on Public Lands. 3. Provides for fines of up to $1000.00 per day for prospecting without a permit 4. Replaces the mining laws of 1872 with a leasing system controlled by the Secretary of Interior. 5. Provides for competitive bidding for acquisition of leases. 6. Requires registration of all unpatented mining claims with BLM and further requires that application for patent be filed within 3 years after registration, (failure to register or apply for patent voids the claim in most instances) 7. Provides for fines of up to $10,000.00 or 6 months in jail, or both, for breaches of lease contract. 8. Provides for annual rental fees and production royalties of NOT'LESS THAN 3 of GROSS PRODUCTION. 9. All leases are subject to whatever rules and regulation the Secretary may promulgate before or after the date of the lease. 10. In essence the Bill gives to the Secretaiy of the Interior absolute and practically unlimited power and authority to regulate and manage the mineral resources of the country and those who are involved in developing same. 11. If enacted, S. 1040 will eliminate 99 of the mining claims held by owners other than the large mining companies.
