Fraud by means of letters, prospectuses, iiewspujMT articles, maps and plats are alleged in carrying out false itrelenses concerning the stability and financial condition of the compuny, as well us its property and coal land holdings. The couiiuny was organized October 21, 1021. Bonds and Mortgages. The persons indicated ure alleged to have represented biddings to be by the Great Western company from the Cedar Mesa Farm, Jnc., included between cigbt bund nil uud a thousand eight hundred acres of cnul lands w hich the farm people owned or controlled, while the fnrin company had title to only nn approximate nine nercs of coal lands, the only dejHwit ever acquired by the Great Western from the farm company. They are said further to have represented that money to he mid for investment was to he used to get the property acquired in shnic for a first mortgage bond issue of $600,000 to construct n railroad to certain coal prcqierties, including the holdings of the farm company, and to develop coal properties claimed to lie or to have been acquired, while the money so raised was used cither wholly or largely by the defendants and their agents as commissions and payment of their pcrsonnl obligations. The bonds arp said to have been represented as first mortgage, though there were existing mortgages and encniiilimnccs in large amounts against the property.
