Show TRU T H 13 SPORTING GOSSIP. The coming contest between Sieloff and McCarthy, which takes place at the Salt Palace theatre, on Tuesday evening next, brings up a matter that ought to bo settled. Ever since tho battle between McCarthy and Daly, the Herald lias missed no opportunities to knock either Manager Kelly of the Shamrock Athletic club, or McCarthy. The paper hasnt played fair at all, but has condemned on evidence that would not be permitted to go In In a trial before an Arkansas justice of the peace, and has held up as being crooked both Kelly and McCarthy, to their Injury before the public. A few days after the fiasco In the Grand theatre made so by the wilful fouling of Daly the Herald declared that an agreement had been entered Into between Daly and McCarthy by which tho former was to lose Inside six rounds for H5 per cent of tho gate receipts; otherwise he was to get nothing. One Tozcr, a ball player, with a reputation not any too good, declared that ho drew up tho agreement and that it was signed in his presence by McCarthy and Daly. Although McCarthy has strenuously denied that any such agreement ever existed and Kelly has expressed a belief in McCarthys statements, tho Herald lias kept up that fight. Of late it has been reproducing an alleged copy of the agreement every time it has had occasion to mention tho contest between Sieloff and McCarthy, tho solo object being to injure tho contest and its management. Now, it looks to tho sporting writer of Truth that It was about time for the Herald to mako good. If it has tho agreement let it reproduce the same; tho paper has facilities for that sort of work and can do it very cheaply, or if it docs not want to reproduce it, send it over to this office and we will. If it has not such a document then let it support its allegations by some reputable person who will mako an affidavit that he saw it. This jumping on a man who Is honestly doing tho best ho can is by no means right. Kelly has, since coming here, endeavored to give tho public squaro sport; to put up men who would box honestly and fairly on their merits. Ho gave us a good fight at Ogden, when McCarthy won a hard fought battle of twenty rounds over It was Kelly who put Walsh. on the contest between Battling Nelson and Spider Welch. Kelly is entitled to just as much credit, just as much honesty as those who were duped by Biddy Bishop in the Salt Palace affair. In all the contests pulled off under the management of tho Shamrock club tho management has lost money, with one exception, that of the contest between Nelson and Welch, and in that case the amount to the good was not sufficient to recompense for the losses in the others. Being desirous of keeping up the sport for the benefit of th030 who like it, Kelly has kept right on and is doing tho best he can to get good men to come here. To assail him when he is in no position to protect himself is unfair and dishonorable and any newspaper that will stoop to such methods is not worthy of the confidence of the public. It is stated on apparently good authority that the Herald will stop its Daly-McCartl- fight on Kelly if the latter will drop McCarthy. Inasmuch as Jerry has always acted fair and honest with Kelly in every relation, there is no good reason for him doing so. Jerry claims he signed no such agreement as was mentioned by the Herald. There is no evidence that he did, except tho statement of Tozcr, and as between tho two Truth prefers to believe McCarthy to Tozer, because a man who will admit that he has fixed up an agreement for two men to fake a fight and then tell about it three days later isnt worthy of credence. Nor has the fight been made against McCarthy been tho bnly unfair one. As is quite well known, Kelly was charged with issuing letters to railroad men, purporting to have come from- the management of various railroads. Under the rule which governs our courts a man is presumed to be innocent until he is found guilty. He is considered Innocent through every stage of tho proceedings until a jury declares him guilty. He does not have to establish his innocence, but on the contrary, if the prosecution does not conclusively demonstrate his 'guilt he may be discharged without offering a word in his own defense. Yet in view of this, and in view of the further fact that people generally have for a line of conduct the methods of the courts, the Herald has, by inuendo, headlines, insinuations and direct statements, taken good care to convey to its clientage every time opportunity has presented itself, the fact that Kelly has been charged with an offense. It has asked Kelly for no r. top-notche- rs - statement and does not indulge in the American system of fair play enough to give him a chance, but hits from behind, like a Greaser assassin, whenever it can. And for no other reason than that it wants to prevent Kelly from handling any boxing contests in signed any such agreement as the Herald mentions; neither does it believe the Herald even thinks so. As to the position Kelly occupies, that is his own affair.' He claims he will be able to successfully defend himself; his attorneys are more than confident. So far as he is concerned in matters of promoting boxing contests and in business affairs, in all his dealings with men he has been a man of and found honest his word. When he made contracts he kept them. We have yet to learn of any man complaining of his breaking either his word or his contract. We personally know that he has lost money trying to promote sport here, and we wish it was otherwise. There is some rivalry as to who shall be the leading boxing contest manager in the city. Both sides have partisans and in their eagerness to see who shall get the inside words are spoken and things said that should not be said. And we have yet to learn that Kelly is the knocker. He seems to be trying to attend to his own affairs and to get the best men here he can to satisfy the large number of people who like boxing. Kelly does not profess to be an angel, but he is doubtless going along as honestly as most of his neighhis and agreebors, keeping ments. In the light of the knowledge Truth has. it believes the course the Herald is taking is despicable and dishonest and it calls for the proof.
