Broadway is asking that Salt Lake City's Wallace Associates Management Inc. be appointed the receiver to handle the operation and maintenance of the property, including the collection of rents and the distribution of income from the building. Mr. Larsen said Granada has been in negotiations with the attorneys for Sears Savings Bank and hopes to work out an agreement with them. "One way or another we'll have to reach some sort of an agreement, Mr. Larsen said. "Right now everyis Granada, since taking control of the property last fall, has been trying to find a buyer for the building, Mr. Larsen said, and has enlisted the help of Coldwell Banker. Mr. Larsen said three potential buyers have expressed an interest in the property and he voiced fear that if a receiver it appointed it could delay the sale of the building. Although Sears Savings several days ago filed a petition with the 3rd District Court asking that a receiver be appointed, that petition was set aside in a hearing Thursday before Judge Judith M. Billings, who ruled that Sears needed to file a complain: with the court before the matter could be considered, according to one attorney involved in the case. State. Gary Sheets. In asking for the appointment of a receiver for the property, Glendale, California's Sears Savings Bank, formerly known as Allstate Savings & Loan Association, says it loaned Broadway Enterprises $5.3 million in December 1983. Broadway is a limited partnership whose general partner is CFS Financial Corp. Sears Savings Bank contends that no payments on the note have been made by Broadway Enterprises since Nov. 1, 1985, and' that the limited partnership is insolvent.
