violation to the Jordan School District for mishanceiling tiles at Southland Eldling asbestos-containin- g ementary School 12675 S 2700 West Riverton Burnell Cordner director of the bureau said inspectors on Oct 27 discoverel that 40 square feet of ceiling tiles had been improperly removed from a classroom by a district employee "Pieces of ceiling tile that had been broken off during the House Tribune Staff Writer A Utah federal judge's ruling against a divorced woman's attempts to use her birth name on her driver's license is wrong said an attorney who will appeal the decision Judge J Thomas Greene decided against Wendy Jorgensen who sued the Utah Driver License Division after an official refused to change Ms Jorgensen's married name to her birth name on her driver's license Ms Jorgensen Magna presented her birth certificate and a divorce decree to a license official to get her named changed last year But the official refused because of a state policy disallowing divorce decrees that have no provisions for using birth names Judge Greene upheld state policy in his Oct 18 decision ruling no common law right exists in Utah allowing a person to choose any name on a state driver's license The judge said Ms Jorgensen could go to court to amend the divorce decree to reflect resumption of her maiden name or she could petition the court to change her name Ms Jorgensen had argued that di vorced women are treated different ly from recently married women who only have to show a marriage certificate to have their names changed — without having to go to court But Judge Greene said the division's policy was reasonable "and had a rationale basis related to a legitimate state interest of maintaining a close watch over its licensees" Ms Jorgensen's attorney Brian Barnard said on Friday he will ap- peal the decision arguing Utah does have a common law allowing women to use their maiden names "When a woman shows her marriage license and asks for her name to be changed on a driver's license boom they change the name" he said "It's simply social custom and common law that allows her to use her husband's name — there's nothbig on the marriage certificate that says she can do that" he said "If it applies going into a marriage it should equally apply in getting out of a marriage" At an August hearing Judge Greene asked Mr Barnard if the division should allow
