An Attorney in Fact is one who is To the Editor: A letter written by a Katherine A. Fox, general counsel for the Utah State Bar, has forced me to respond. Her first point was that, "No one is legally permitted to practice law in Utah without graduating from an American Bar Asso- ciation approved law school" is flat out wrong. In Utah, a candidate for "Attorney Admission" may be a graduate of a an agent or representative of another given authority to act in that person's place and name and do non-AB- A approved law school. Many people practice law without being a member of the Utah Bar. They work for federal administrative agencies such as the IRS, Social Security Administration and the Federal Patent Office, among others. Employees of corporations also can practice law without being a member of the Utah Bar. Ms. Fox's second point was that a Juris Doctorate degree does not confer the right to practice law in Utah. I agree. It is an academic degree that teaches about the law. Her third point was that Monticello University is not an ABA approved law school. The article never said it was. The article to which she is referring said rightly that the degrees it grants are recognized by the U.S. Department of Education. 1 had no intention of joining the bar so why would I worry about the school being ABA approved? As stated whatever that person can legally do for himself. The document giving the attorney his authority is called a Power of Attorney (155 Ca. Rptr. 843, 849) An Attorney at Law is one w ho is a member of the Bar. (see also Barron's Law Dictionary, Gilbert Law' Dictionary, etc.) Any act a person does under the Pow er of Attorney is a legal act. A third party cannot disavow or revoke a Power of Attorney. As for what I do in my business, I am a consultant that helps people during the time of divorce by utilizing programs created by Divorce Care Ministries and the American Association of Christian Counselors.
